Title
An ordinance to establish a Franchise Fee for cable service or video service provided under The Consumer Choice For Television Act (Act 433 of the 2008 Regular Session of the Louisiana State Legislature).
Body
WHEREAS, The Louisiana State Legislature adopted Act No. 433 during the 2008 Regular Session which allowed Cable Service or Video Service Providers to file an application for a state franchise with the Secretary of State and avoid local franchising authorities; and,
WHEREAS, the current Cable and Video Service Franchise provides for a franchise fee to cover the use of public rights of way however, the new Act provides that this fee must now be adopted by Ordinance of the local governing authority; and,
WHEREAS, pursuant to the provisions of LRS 45:1366, the holder of a state issued certificate of franchise authority for cable or video service is required to pay a franchise fee to a Parish in which it operates upon the passage of an Ordinance setting such fee.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That there is hereby imposed a franchise fee in the amount of five percent (5%) of the certificate holder's gross revenues received from the provision of cable service or video service to subscribers located within St. Charles Parish and from advertising disseminated through cable service or video service and home shopping services as allocated under and defined in the Consumer Choice for Television Act of 2008 (LRS 45:1366).
SECTION II. That said franchise fee imposed herein shall be due and payable quarterly to St. Charles Parish through its Department of Finance.
