Title
An ordinance of the Parish of St. Charles providing that the Code of Ordinances, Parish of St. Charles, be amended by revising Chapter 2, Section 2-12.VIII. Prohibition, to limit the work that can be performed by Contracting Engineering Companies when they are selected to perform Program Management work in St. Charles Parish under QBS.
Body
WHEREAS, The Qualification Based Selection Review Panel (QBS) selects all Engineering Contractors to perform any capital projects above the value of $20,000.00; and,
WHEREAS, in the past years the QBS Panel did not select Engineering Contractors to perform capital projects and also manage as program managers; and,
WHEREAS, in the past, Engineering Companies selected to perform program management work also bid and were selected by QBS for capital projects and drainage/sewerage projects; and,
WHEREAS, the same Engineering Companies tend to get the number of engineering/consulting contracts under the value of $20,000.00; and,
WHEREAS, it has come to the attention of the Council that the same Engineering Company is performing in several capacities on engineering projects, i.e., Program Manager, Capital Projects Engineering Contractor, Subdivision Development Review Engineer, Construction Quality Assurance Inspector, and all other assigned projects by the Administration; and,
WHEREAS, Companies performing Program Management Engineering Services for St. Charles Parish should be selected by QBS because of the volume of work and accumulated invoices that collectively amount to more than $20,000.00 (e.g. Road Overlay Program, Drainage and Wastewater Projects, Surveying, and Inspection Services, etc.); and,
WHEREAS, Companies performing Consulting Engineering Services for St. Charles Parish on Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services, etc. are also being hired to perform Program Management on similar type projects on Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services; and,
WHEREAS, it is in the best business interest of St. Charles Parish to clearly separate engineering roles and responsibilities by developing Program Management roles which would manage individually Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services; and,
WHEREAS, it is in the best interest of St. Charles Parish that Companies providing Program Management shouldn't perform Consulting Engineering on any projects related to the subject for which they provide Program Management.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Section 2-12.VIII. Prohibition, of the Code of Ordinances of the Parish of St. Charles be amended so that such Section shall include the following language.

ADD:
(a) Any Company providing Program Management Services associated with Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services for St. Charles Parish shall not be hired or perform any Engineering and/or Consulting Services which would conflict or be associated with Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services for St. Charles Parish that said Company has been hired to provide Program Management.
(b) Any Company providing Engineering and/or Consulting Services associated with Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services for St. Charles Parish shall not be hired or perform any Program Management Services which would conflict or be associated with Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services for St. Charles Parish that said Company has been hired to provide Engineering and/or Consulting Services.
(c) Any Company providing Program Management shall be selected by QBS because of the collective accumulation of invoices which easily exceed the $20,000.00 requirement on Road Overlay, Drainage, Wastewater Projects, Surveying, and Inspection Services that the QBS selection process provides for.
(d) Companies performing Program Management Engineering Services for St. Charles Parish should be selected by QBS because of the volume of work and accumulated invoices that collectively amount to more than $20,000.00 (e.g. Road Overlay Program, Drainage and Wastewater Projects, Surveying, and Inspection Services, etc.).
REVISED:
(e) Any architectural or engineering firm, including officers and agents, submitting a proposal for review and consideration for a parish project is expressly forbidden from contacting, lobbying, soliciting or attempting to influence any QBS panel member prior to or following the selection process. Violation of these prohibitions shall automatically cause the offending firm to be disqualified from consideration for the pending project and may result in disqualification for all future projects for a period to be determined by a majority of the QBS board. QBS panel members shall immediately report any and all violations to the parish attorney.
