Title
An ordinance to repeal Ordinance No. 06-10-13, the St. Charles Parish Flood Damage Prevention Ordinance, Section XX.C.2., to adopt the Advisory Base Flood Elevations (ABFE) issued by the Federal Emergency Management Agency (FEMA) after Hurricanes Katrina and Rita.
Body
WHEREAS,      the adoption of the Advisory Base Flood Elevations (ABFE) has posed undue and unnecessary financial hardship to many of those who have built to the ABFE; and,
WHEREAS,      many individuals wishing to build in the future may be posed with the same undue and unnecessary financial hardship by having to build at the ABFE; and,
WHEREAS,      meeting the requirements of the ABFE in many cases has caused the constructed building to look out of place; and,
WHEREAS,      the granting of variances to ABFE by the Zoning Board of Adjustments has been inconsistent, arbitrary, and capricious thereby causing discontent between neighbors in many cases and a lack of coherence in policy; and,
WHEREAS,      the net effect of the adoption of the ABFE ended up being a suggestion to which the property owners do not have a choice of opting out of; and,
WHEREAS,      the decision to build at an elevation in excess of 12" above the crown of the street in front of a lot in cases where this elevation is lower that the ABFE should be the decision of the property owner with the owner carrying the burden and consequences of building to the elevation that they desire; and,
WHEREAS,      the repeal of the ABFE has no detrimental consequences to the government of St. Charles Parish.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
      SECTION I.      That Ordinance No. 06-10-13, the St. Charles Parish Flood Damage Prevention Ordinance, Section XX.C.2., to adopt the Advisory Base Flood Elevations (ABFE) issued by the Federal Emergency Management Agency (FEMA) after Hurricanes Katrina and Rita is hereby repealed.
