Title

An ordinance to amend Ordinance No. 03-8-3 an Engineering Services contract with Shread-Kuyrkendall & Associates, Inc. for the design of Parish Project No. WWKS-44, East Bank Plant Upgrade to comply with grant funding requirements.

Body

WHEREAS,      St. Charles Parish is applying for federal Long Term Community Recovery grant funding through the Department of Housing and Urban Development to fund the reimbursement of $1,052,948.00 of engineering and design expenditures for the East Bank Plant Upgrade incurred through a contract executed with Shread-Kuyrkendall & Associates approved through Ordinance No. 03-8-3; and,

WHEREAS,      (24 CFR 85.36(f)(4)) Title 24:  Housing and Urban Development Code of Federal Regulations Section 85.36(f)(4) states that "the cost plus a percentage of cost and percentage of construction cost methods of contracting shall not be used" in contracts procuring property or services using federal grant funding from the Department of Housing and Urban Development and said contract uses the percentage of construction cost method; and,

WHEREAS,      Amendment No. 2 to said contract includes a negotiated lump sum equal to the amount calculated using the percentage of construction cost method.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

      SECTION I.      That Amendment No. 2 to the Engineering Services Contract with Shread-Kuyrkendall & Associates, Inc. for the design of Parish Project No. WWKS-44, East Bank Plant Upgrade is hereby approved.

      SECTION II.      That the Parish President is hereby authorized to execute said Amendment No. 2 to the Engineering Services Contract on behalf of St. Charles Parish.
