Title
An ordinance authorizing the Parish President to waive any and all subdivision fees required in the completion of a charitable donation of real property from a private entity to a governmental or an inter- governmental agency in St. Charles Parish.
Body
WHEREAS, St. Charles Parish and other governmental agencies in St. Charles Parish have been the receiver of several donations of real property from private entities throughout the years; and,
WHEREAS, the St. Charles Parish Subdivision regulations require that if property is to be legally be transferred from on entity to another it should be a legal lot of record; and,
WHEREAS, if the property to be donated is a portion of a larger lot of record, a legal subdivision shall be require; and,
WHEREAS, the St. Charles Parish Subdivision Regulations sets for a fee for each subdivision accepted by the St. Charles Parish Department of Planning and Zoning; and
WHEREAS, the St. Charles Parish Subdivision regulations have not provisions to waive subdivision fees for charitable donations from a private entity to a governmental or an inter- governmental agency in St. Charles Parish; and,
WHEREAS, charitable donations of real property from a private entity to a governmental or an inter- governmental agency in St. Charles Parish should be made with minimum cost to the donator.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the St. Charles Parish Code Appendix C Section V.A is amended by adding the following:
5. The St. Charles Parish President shall waive any and all subdivision fees required in the completion of a charitable donation of real property from a private entity to a governmental or an inter- governmental agency in St. Charles Parish. Notwithstanding any provisions of the law, this section shall not be construed to include donations made to St. Charles Parish as satisfaction of any requirement by the St. Charles Parish Subdivision Regulations nor any other requirements of federal, state or local law
