Title
An ordinance to revoke Ordinance No. 14-8-9 and approve the revised, executed Department of the Army License No. DACW29-2-15-18 to allow the continued use of the Bonnet Carre’ Spillway Road from Norco to Montz.
Body
WHEREAS, the St. Charles Parish Police Jury on January 24, 1971, was issued License No. DACW29-3-71-78 by the U.S. Army Corps of Engineers for the maintenance and operation of a public road through the Bonnet Carre’ Spillway; and,
WHEREAS, said license was for a period of five (5) years and was extended on February 20, 1976, December 6, 1984, January 12, 1989, September 10 1993, January 25, 1999, January 25, 2004, and October 5, 2009; and,
WHEREAS, the current license expired on January 20, 2014, and it is the intent of the Parish Council to approve the revised license in perpetuity; and,
WHEREAS, the St. Charles Parish Council approved Ordinance No. 14-8-9 on August 4, 2014, which approved and authorized the execution of Department of the Army License No. DACW29-2-14-48; and,
WHEREAS, the Department of the Army revised License No. DACW29-2-14-48; and,
WHEREAS, it has been determined that the revised license with Department of the Army is in the best interest of the citizens of St. Charles Parish.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 14-8-9 adopted August 4, 2014 is hereby revoked.
SECTION II. That the revised, executed Department of the Army License No. DACW29-2-15-18 for the Bonnet Carre’ Spillway Road is hereby approved.
The foregoing ordinance having been submitted to the vote, the vote thereon was as follows:
And the ordinance was declared adopted this _____ day of ___________, 2015, to become effective five (5) days after publication in the Official Journal.
