Title
An Ordinance to authorize the Parish President to execute an Act of Sale with G.H.F., L.L.C., et al for the purchase of property needed for the implementation of the Wastewater Regionalization Program.
Body
WHEREAS,      St. Charles Parish is in immediate need of the ownership of certain property on which the Eastbank Wastewater Treatment Facility is situated; and,
WHEREAS,      St. Charles Parish and G.H.F., L.L.C., et al have heretofore entered into a Purchase Agreement for St. Charles Parish's purchase of property from G.H.F., L.L.C., et al, which said Purchase Agreement is now in dispute.; and
WHEREAS,      St. Charles Parish has the need to acquire additional acreage for the plant site, and G.H.F., L.L.C., et al has agreed to sell St. Charles Parish said additional acreage it needs.; and
WHEREAS,      St. Charles Parish and G.H.F., L.LC., et al have agreed that St. Charles Parish will purchase via Act of Sale from G.H.F., L.L.C., et al, the real property it needs for the site of the Eastbank Wastewater Treatment Facility, for and in consideration of the sum of TWO HUNDRED THIRTY-ONE THOUSAND ONE HUNDRED TWENTY AND NO/100THS ($231,120.00) DOLLARS, which said property is described as follows, to-wit:
Commence from a point on the northerly right of way line of the Illinois Central Gulf Railroad (formerly the Y&MV Railroad) and the intersection of the westerly property lie of the Louisiana Power & Light Company's Destrehan Substation; thence N07º56'E a distance of 600.00 feet to the northwesterly corner of Louisiana Power & Light Company's Substation); thence N64º56'24"E a distance of 18.56 feet to the point of beginning for Parcels 1 and 2; thence N07º56'00"E a distance of 50.00 feet to a point, the point of beginning for new Regional Sewer Treatment Plant.  Measure thence N82º04'00"W a distance of 50.00 feet; thence S07º56'00"W a distance of 50.00 feet to a point of curvature; thence in a southerly direction along the arc of a curve to the left having a radius of 125.00 feet an arc length of 53.04 feet, a chord of S04º13'21"E a chord distance of 52.64 feet to a point of reverse curvature; thence in a southerly direction along the arc of a curve to the right having a radius of 75.00 feet an arc length of 31.83 feet, a chord of S04º13'18"E a chord distance of 31.60 feet to a point; thence S07º56'00"W a distance of 453.47 feet to a point on the northerly right of way line of proposed 50 foot road; thence N63º25'00"W a distance of 490.71 feet; thence N09º04'24"E a distance of 1112.43 feet; thence S80º53'09"E a distance of 475.17 feet;  thence S07º56'00"W a distance of 673.52 feet to a point, the point of beginning.  Said parcel contains 12.840 acres.  All as more fully shown on plan by BFM Corporation dated May 31, 2000. Begin at the intersection of the northerly right of way line of the Illinois Central Railroad (formerly the Y & MV Railroad) and the intersection of the westerly property line of the Louisiana Power & Light Company's Destrehan Substation;
 
Thence S20º12'33"E a distance of 131.46 feet to a point on the northerly right of way line of Noel Street;
 
Thence along said northerly right of way line N63º25'00"W a distance of 73.03 feet to a point;
 
Thence N20º12'33"W a distance of 90.76 feet to the point;
 
Thence N07º56'00"E a distance of 39.96 feet to a point on the southerly right of way line of an existing 50' access road;
 
Thence along said southerly right of way line S63º25'00"E a distance of 52.77 feet to a point on the westerly property line for an L.P.&L. Substation.
 
Thence S07º56'00"W a distance of 10.55 feet to the point of beginning.
 
Said parcel contains 0.157 acres.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.      That the Parish President of St. Charles Parish is hereby authorized to execute an Act of Sale between St. Charles Parish and G.H.F., L.L.C., et al of the above described property for the above-stated consideration, said Act of Sale to be in the form of the documents attached hereto and made a part hereof.
