Title
An ordinance to authorize the Parish President to accept an offer from International Matex Tank Terminals LLC (“IMTT”) to purchase a perpetual pipeline servitude/easement/right-of-way for a total consideration of $9,260.00.
Body
WHEREAS, IMTT is seeking to acquire a perpetual servitude/easement/right-of-way for the construction and operation of three (3) intrastate pipelines not to exceed eighteen and five-tenths (18.50”) inches across a tract of property owned by St. Charles Parish; and,
WHEREAS, the proposed pipelines shall be used for the transportation of oil, natural gas, other gases, water, liquids, or hydrocarbons from IMTT’s St. Rose facility to both the Valero and Shell refineries in Norco, Louisiana; and,
WHEREAS, the subject property, concerns a .093 acre parcel of an undeveloped subdivision lot in New Sarpy with a legal property description bearing Section 8, Township 12 South, Range 8 East, and which is more fully shown in the attached drawing by BRIS Engineering, LLC. The aforementioned property was acquired by St. Charles Parish through adjudication for unpaid taxes and has never been redeemed; and,
WHEREAS, IMTT is a “common carrier” that is vested with expropriation authority under La.R.S. 19:2, et seq.; and,
WHEREAS, in lieu of instituting expropriation proceedings, IMTT has proposed to purchase from St. Charles Parish a perpetual pipeline servitude/easement/right-of-way over the subject property for a total consideration of $9,260.00; and,
WHEREAS, IMTT has obtained an appraisal from licensed appraiser, Neal S. Meyer, with Murphy Appraisal Services, LLC wherein Mr. Meyer has estimated a total compensation value for proposed servitude across the subject property to be $5,364.00; and,
WHEREAS, IMTT’s offer meets or exceeds the estimated appraised value of the proposed servitude; and,
WHEREAS, IMTT’s proposal provides just compensation and it is in the furtherance of the public’s best interest to accept the offer to purchase the aforesaid described pipeline servitude and avoid the costs and expense of litigating the matter through expropriation proceedings.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION 1. That the President of St. Charles Parish is hereby authorized to accept on behalf of St. Charles Parish the offer to purchase a perpetual pipeline servitude/easement/right-of-way across the tract of property more particularly described on the drawing by BRIS Engineering, LLC, which is attached hereto and made a part hereof for the amount of $9,260.00. The President of St. Charles Parish is hereby further authorized to execute any documents necessary to complete said purchase by IMTT.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
