An ordinance of the Parish of St. Charles to provide that the Code of Ordinances, Parish of St. Charles, be amended by revising Section 19-1. Planning & Zoning Commission of said Code, to specify that the seven (7) district representatives must reside in their respective districts of representation and nomination by that District's Councilmember and/or Councilmember-At-Large serving Division A or B; and ex-officio non-voting members:  one (1) member of the Parish Council designated by the Council, one (1) member of the School Board designated by the School Board, and the Parish President or an administrative employee designated by him/her.

WHEREAS,      Article III, Section C.4, of the Home Rule Charter provides for the membership of the Planning & Zoning Commission; and,
WHEREAS,      Article III, Section C.4 does not restrict or prohibit the Parish Council from making changes in the appointment process in respect to domicile or appointee; and,
WHEREAS,      Article III, Section A.7.b. of the Home Rule Charter provides the authority for the Parish Council to enact any ordinance necessary, requisite or proper to promote, protect, and preserve the general welfare, safety, health, peace, and good order of St. Charles Parish not inconsistent with the Constitution of the State of Louisiana or denied by general law or this Charter; and,
WHEREAS,      Article III, Section A.7.c.x authorizes the Parish Council to provide budgetary, fiscal, and other controls over all special boards, commissions, agencies, districts, or any device having governmental functions which it or its predecessor has created to insure the maximum coordination of government at the local level in St. Charles Parish.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.      That Section 19-1. Planning & Zoning Commission of the Code of Ordinances of the Parish of St. Charles, be amended so that such Section shall read as follows:
Section 19-1.  Planning & Zoning Commission
  1. The Planning & Zoning Commission shall be composed of the following membership:  seven (7) district representatives who must be domiciled within that District and nominated by that District's Councilmember and/or Councilmember-At-Large serving Division A or B; and ex-officio non-voting members:  one member of the Parish Council designated by the Council, one member of the School Board designated by the School Board, and the Parish President or an administrative employee designated by him/her.
  2. All members of the Planning & Zoning Commission shall be appointed for a term of four (4) years from and after the expiration of the term of their predecessors in office and upon moving from their appointed district during their term; must resign from their appointed position.
  3. If a vacancy occurs other than by expiration of a term, the vacancy shall be filled by appointment for the unexpired term by the appropriate District Councilmember.
