Title
An ordinance to amend the St. Charles Parish Code of Ordinances, Chapter 2, Administration, Article I. In General, Section 2-12. Procedures for the procurement of architects and engineers., I. Special Provisions., to amend Sub-section (a) and remove Sub-section (b) in its entirety.
Body
WHEREAS, the Louisiana Attorney General (AG) issued Opinion 12-0133 which advised that the President has the sole authority to select and hire consulting or contract for architectural services for the Parish and that any part of the St. Charles Ordinance § 2~12 that usurps that authority of the President is void; and,
WHEREAS, and amendment to “Section 2-12. Procedures for the procurement of architects and engineers” is needed so as to have this section of the Parish code be brought into compliance with the Parish’s Home Rule Charter.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the St. Charles Parish Code of Ordinances, Chapter 2, Administration, Article I. In General, Section 2-12. Procedures for the procurement of architects and engineers. I. Special Provisions., Sub-section (a) be amended as follows and Sub-section (b) is hereby removed in its entirety:
AS WRITTEN:
I. Special Provisions.
(a) Any contract for consulting engineers or architectural services involving the public works, sewerage, or waterworks department of any St. Charles Parish government office, agency, commission or special district which would result in a fee in the amount of twenty thousand dollars ($20,000.00) or more shall be awarded based on the recommendation of the parish president. Any such project resulting in a fee of less than the twenty thousand dollars ($20,000.00) threshold shall be handled administratively by the appropriate department, in its sole discretion, from utilizing this selection process whenever it is deemed appropriate. A report listing all contracts for consulting engineers or architectural services handled administratively shall be forwarded to the parish council monthly. Five (5) days after execution of any administrative contract, notice regarding award of this contract shall be forwarded to the district councilman and councilmen-at-large.
(b) Any contract for consulting engineering or architectural services which would result in an engineering or architectural fee in an amount of twenty thousand dollars ($20,000.00) or more shall be awarded by ordinance of the parish council.
AS REVISED:
I. Special Provisions.
(a) Any contract for consulting engineers or architectural services involving the public works, sewerage, or waterworks department of any St. Charles Parish government office, agency, commission or special district shall be awarded by the Parish President following the administration’s selection of the consultant or architectural firm. Five (5) days after execution of any such contract, notice regarding award of such contracts when such contracts pertain to work or an item situated in the local councilperson’s district, shall be forwarded to the district councilperson, the councilmen-at-large, and the council secretary. A report listing all contracts for consulting engineers or architectural services entered into by the Parish President shall be forwarded to the council secretary monthly for distribution to the Parish Council. The report shall identify the source of the funds authorized in the Parish budget by the Parish Council which is a prerequisite to entering into such contracts.
