Title

An ordinance to amend Chapter 26-2 and 26-4 of the St. Charles Parish Code of Ordinances to update the composition of the Coastal Zone Advisory Committee.

Body

WHEREAS,                     Ordinance No. 15-10-13 adopted Chapter 26, the St. Charles Parish Local Coastal Program; and,

WHEREAS,                     the ordinance contains conflicting language regarding the Coastal Zone Advisory Committee; and,

WHEREAS,                     the St. Charles Parish Council wishes to correct the conflicting language and provide for a Coastal Zone Advisory Committee to be reseated with staggered terms.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     Chapter 26, Section 26-2 of the St. Charles Parish Code of Ordinances is amended as follows, with deleted text in strikethrough and additional text in underline:

                       Local coastal program advisory committee Coastal Zone Advisory Committee or committee Committee means the group of nine seven individuals representing coastal area user groups.

SECTION II.                     Chapter 26, Sec. 26-4 of the St. Charles Parish Code of Ordinances is amended as follows, with deleted text in strikethrough and additional text in underline:

Sec. 26-4. Local coastal zone management advisory committee Coastal Zone Advisory Committee.

(a) The committee shall include representatives from various interest groups or government agencies to encourage full use of the coastal resources recognizing that it is in the public interest of the people to establish a proper balance between development and conservation. Its membership shall be appointed by a majority vote of the parish council.

(b) A member shall be removed by the parish council only for good cause during their four-year term. Within the first six months of each term, the council may remove or replace committee members without cause. With no action on the part of the council, committee members shall remain in their seats as there are no express term limits. The committee chairperson is to be selected by standing members.

(b) All members shall be appointed by a majority vote of the Parish Council. Initial terms of the first two (2) members appointed shall be for two (2) years, initial terms for the next two (2) members appointed shall be for three (3) years and initial terms for the next three (3) members appointed shall be for four (4) years, effective August 1, 2025. Thereafter, members of the Committee shall be appointed for a term of four (4) years. Appointments to fill an unexpired term shall be made for the remainder of the term.

(c) Committee activities shall be coordinated by the CZM administrator.

(c) A member may be removed for good cause by majority vote of the Parish Council.

(d) The seven-member advisory committee will be appointed by the parish council with a member appointed by each council member.

(d) The Committee shall elect a Chairman and Vice-Chairman. The Committee shall adopt rules of operation. The Committee activities shall be coordinated by the CZM Administrator.

SECTION III.                     The terms of any members who served on the Coastal Zone Advisory Committee and have no record of resignation shall expire on July 31, 2025.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
