Title
An ordinance to amend the Zoning Ordinance of 1981, Ordinance No. 81-10-6, adopted October 19, 1981 to rescind Ordinance No. 87-12-8 in order to reverse the zoning classification from R-1AM to CR-1 at Lot 52, Charles Natis Tract, Luling, La.
Body
WHEREAS, Ordinance No. 87-12-8 dated December 21, 1987 authorized conditional rezoning to Lot 52, Charles Natis Tract, Luling, La.; and,
WHEREAS, the condition written within Ordinance No. 87-12-8 was to reclassify the property as R-1AM zoning “with the stipulation that it be for a period of five (5) years”; and,
WHEREAS, the St. Charles Parish Department of Planning & Zoning considers conditions placed upon rezonings to be invalid and unenforceable; and,
WHEREAS, the current owner of the property has applied for the property to be rezoned from R-1AM to CR-1; and,
WHEREAS, during consideration of this request, the St. Charles Parish Planning & Zoning Commission decided to resolve the conditional zoning by recommending that the original Ordinance be rescinded rather than recommend approval of a new Ordinance to rezone the property from R-1AM to CR-1.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. The St. Charles Parish Council hereby authorizes that the Zoning Ordinance of 1981, Ordinance No. 81-10-6, adopted October 19, 1981 be amended by rescinding Ordinance No. 87-12-8 that approved the zoning classification from CR-1 to R-1AM at Lot 52, Charles Natis Tract, Luling, La. “with the stipulation that it be for a period of five (5) years.”
SECTION II. To authorize the Department of Planning & Zoning to amend the official St. Charles Parish Zoning Maps to reflect the reclassification from R-1AM to CR-1 at Lot 52, Charles Natis Tract, Luling, La. as requested by Ida Marie Green.
