Title

An ordinance to amend Ordinance No. 98-12-2, a MORATORIUM on further development of major subdivisions, to revise Section III to provide that the Moratorium Ordinance shall not affect any subdivision which has received preliminary plat approval prior to the effective date of Ordinance No. 98-12-2.

Body

WHEREAS,                     Ordinance No. 98-12-2, the Moratorium Ordinance, provides in Section III that "subdivisions pending approval and commercial development will come under this ordinance"; and,

WHEREAS,                     to prevent misinterpretation of this Section, the Parish Council would like to clarify the intent and purpose of the provision; and,

WHEREAS,                     it is the intent of the Parish Council that the Moratorium Ordinance shall not affect any subdivision which has received preliminary plat approval prior to the effective date of Ordinance No. 98-12-2; and,

WHEREAS,                     Preliminary Plats which have been approved by the Planning & Zoning Commission will be "grandfathered" and shall not be affected by the Moratorium Ordinance; and,

WHEREAS,                     maps defining the areas affected by Moratorium Ordinance No. 98-12-2 shall be available for viewing at the Office of the Parish Council Secretary, Department of Planning & Zoning, and East and West Libraries; and,

WHEREAS,                     Ordinance No. 98-12-2 does not affect any resident wishing to construct a home on their lot which has already been approved for development.

WHEREAS,                     it is the desire of this Council and Citizens' Groups not to halt economic activity in the Parish and at the same time complete drainage and sewage projects approved and funded on a timely fashion, thus enable Planning & Zoning Commissioners to approve major developments without hesitation or mental reservations.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS: 

                     Section I.                     That Section III of Ordinance 98-12-2 shall be amended to read as follows:

Subdivisions pending approval and commercial development will come under this ordinance.  The Moratorium shall not affect any subdivision which has received preliminary plat approval prior to the effective date of Ordinance No. 98-12-2. Preliminary Plats which have been approved by the Planning & Zoning Commission will be "grandfathered" and shall not be affected by the Moratorium Ordinance.  The Moratorium shall not affect any resident wishing to construct a home on their lot which has already been approved for development.

NOW, THEREFORE, BE IT ORDAINED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL do hereby amend Ordinance No. 98-12-2, a MORATORIUM on further development of major subdivisions, to revise Section III to provide that the moratorium ordinance shall not affect any subdivision which has received preliminary plat approval prior to the effective date of Ordinance No. 98-12-2.; and,

BE IT FURTHER ORDAINED, that the Administration will work with the engineers and contractors to set up landmark progress dates on all projects in the affected areas where moratorium is in effect and update the Parish Council on a monthly basis to enable the Council to lift the moratorium at the earliest opportunity.

And the ordinance was declared adopted this 19th day of January, 1999, to become effective five (5) days after publication in the Official Journal.
