Title
An ordinance approving and authorizing a home occupation under the operation of Terri and Richard Tracy, Jr. - "Treasure Hunt Arms, Inc" - a firearms dealer - at 302 Davis Drive, Luling.
Body
WHEREAS, the St. Charles Parish Code of Ordinances, Appendix A, Section XXII states that the Parish Council must approve a home occupation requiring any state license or permit; and,
WHEREAS, the proposed home occupation of Terri and Richard Tracy, Jr. requires licensing by the Bureau of Alcohol, Tobacco, Firearms, and Explosives; and,
WHEREAS, at a meeting on June 7, 2012, the St. Charles Parish Planning and Zoning Commission heard the Planning and Zoning Director's recommendation that the request be granted with the following stipulations:
1. That the Tracy's obtain the federal firearms license prior to obtaining an occupational license at the address.
2. That no transfer of firearms occur at the residence at any time.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the home occupation application by Terri and Richard Tracy, Jr. to operate "Treasure Hunt Arms, Inc."- selling and transferring firearms at gun shows and using the internet-is approved.
SECTION II. That upon receipt of the required federal firearms license, the Department of Planning & Zoning is authorized to grant Terry and Richard Tracy, Jr. a home occupation permit to operate "Treasure Hunt Arms, Inc." - selling and transferring firearms via internet- at 302 Davis Drive, Luling.
SECTION III. That the approval of the home occupation permit is contingent upon the stipulations that a federal firearms license is obtained prior to obtaining an occupational license and that transfers of firearms will not occur at the residence.
