Title
An ordinance to approve and authorize the execution of a Contract for Engineering Services Agreement with Evans-Graves Engineers, Inc. for the East Bank Hurricane Protection Levee Pumps.
Body
WHEREAS, the United States Army Corps of Engineers has now completed approximately 56% of the East Bank Hurricane Protection Levee, nearing completion of the "First Lift"; and,
WHEREAS, the current project includes four flow through drainage structures to allow for the flow of rain water from the developed areas of the East Bank to Lake Pontchartrain; and,
WHEREAS, during a hurricane event these drainage structures will be closed, creating severe flooding of US Highway 61 and eventually backing up into the developed areas of the East Bank; and,
WHEREAS, on August 8, 1995, the United States Army Corp of Engineers issued a Permit to St. Charles Parish to allow for the construction of pumping stations along the levee system; and,
WHEREAS, on May 21, 2001 the Parish Council adopted Resolution No. 4917 expressing its intent to designate Evans-Graves Engineers, Inc. to act as liaison between the Parish and the U.S. Army Corps of Engineers to develop the criteria for the Parish to qualify for the SELA Reconnaissance Study, to work on the Feasibility Study and to seek funding for the project; and,
WHEREAS, on October 1, 2001 the Parish Council adopted Ordinance No. 01-10-5 approving an Intergovernmental Agreement with the Pontchartrain Levee District to cooperatively pursue drainage conveyance system and pumps for the East Bank Hurricane Protection Levee; and,
WHEREAS, the Pontchartrain Levee District has employed Evans-Graves Engineers, Inc. to accomplish this task; and,
WHEREAS, it is in the best interest of the Parish to provide for the continuity of the services of Evans-Graves Engineers, Inc. in pursuing this project through its construction; and,
WHEREAS, Evans-Graves Engineers, Inc. has agreed to pursue funding for this project, understanding that it is beyond the ability of the Parish to fund; and,
WHEREAS, it is the desire of the Parish Council to approve said Contract.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the provisions of the Code of Ordinances, Chapter 2, Article I, Section 2-12, regarding the selection of Engineering firms, is hereby waived.
SECTION II. That the Contract for Engineering Services by and between St. Charles Parish and Evans-Graves Engineers, Inc. is hereby approved.
SECTION III. That the Parish President is hereby authorized to execute said Contract on behalf of St. Charles Parish.
SECTION IV. SUB CONTRACTORS
Employ the necessary United States Army Corps of Engineers approved (indefinite delivery contract approved as of June 12, 2001) engineering consultants to investigate the feasibility and technical aspects of constructing a conveyance system and pumping system to move rain water to the proposed pumps within the East Bank Hurricane Protection Levee and pump the water over the levee, along with pursuing potential funding sources. All engineering firms working on this project shall be officially licensed engineering firms in the State of Louisiana as of January 1, 2001.

And the ordinance was declared adopted this 22nd day of July , 2002, and to become effective five (5) days after publication in the Official Journal.
