Title
An ordinance to approve the resubdivision of property of Huey J. Rivet being a portion of Lots 911 & 975 of the Sunset Drainage District into Lots 1 through 24, in Sections 10 & 38, T15S R20E, St. Charles Parish, LA.
Body
WHEREAS,      Huey J. Rivet owns Lots 911 & 975 as per plan of Michael D. Bernard, P.L.S. dated May 14, 2004, near Des Allemands, St. Charles Parish, La.; and,
WHEREAS,      the owner wishes to subdivide the identified tract into Lots 1-24, and a 7.94 acre slip identified as "Kerry's Pointe Waterfront Community"; and,
WHEREAS,      the Department of Planning & Zoning has determined that this development is best suited for an R-3 Zoning Classification as a particular fit for what the comprehensive plan specifies to "maintain the unique rural character of the residential community along Bayou Gauche Road and the fishing village atmosphere along Bayou Gauche"; and,
WHEREAS,      the proposed subdivision and development plan meets the standards contained within the local subdivision and zoning ordinances.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.      That the resubdivision plan presented on a survey by Michael D. Bernard, P.L.S. dated May 14, 2004, entitled Final Plat Kerry's Pointe Waterfront Community Subdivision of a portion of Lots 911 & 975 of the Sunset Drainage District into Lots 1 through 24, in Sections 10 & 38, T15S-R20E, near Des Allemands, St. Charles Parish, State of Louisiana is hereby approved.
SECTION II.      It is hereby understood that said subdivision has been constructed outside of the Sunset Drainage District protection levee and pump system therefore, it is subject to tidal flooding and no public drainage system or improvements are provided.
SECTION III.      That this development is being approved as a private development with all streets, street lighting, water system, sewer system, and drainage system to be the sole and complete responsibility of the Kerry's Pointe Waterfront Community Home Owners Association and the individual lot owners of said subdivision.
SECTION IV.      That due to the lack of turnarounds and public streets, curbside garbage service and school bus service will not be provided within the subdivision.
SECTION V.      No lots shall be sold in this subdivision until the required public street improvements are installed by the developer from Badeaux Lane west to the entrance to said subdivision.
