Title
A resolution approving Amendment #1 of the St. Charles Parish RESTORE ACT Multiyear Implementation Plan for submission and approval to the U.S. Department of the Treasury in accordance with the requirements of the RESTORE ACT.
Body
WHEREAS, the RESTORE Act established the Gulf Coast Restoration Trust Fund (hereinafter referred to as Trust Fund) in the U.S. Department of the Treasury (hereinafter referred to as Treasury); and,
WHEREAS, eighty percent (80%) of the civil penalties paid after July 6, 2012, under the Federal Water Pollution Control Act in connection with the Deepwater Horizon oil spill will be deposited into the Trust Fund and invested by Treasury; and,
WHEREAS, thirty-five percent (35%) of amounts deposited into the Trust Fund are available as Direct Component Allocations to four (4) Gulf Coast states, 23 Florida counties, and 20 Louisiana parishes, including St. Charles Parish; and,
WHEREAS, Trust Fund amounts will be available for eligible activities described in the RESTORE Act; and,
WHEREAS, as of April 17, 2024, St. Charles Parish’s Trust Fund Allocation, including Transocean and Anadarko Penalty and Interest Payment Deposits and BP Penalty Deposits available for use is $514,008.95; and,
WHEREAS, the Direct Component is governed by the regulations at 31 Code of Federal Regulations (hereinafter referred to as C.F.R.) Part 34, as well as the Office of Management and Budget final guidance, Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, at 2 C.F.R. Part 200, at 79 Federal Register 75880 (December 19, 2014); and,
WHEREAS, the Multiyear Implementation Plan (hereinafter referred to as MIP), consisting of a Multiyear Plan Matrix, a map showing locations of proposed project, and a narrative description of the project described therein, must be made available for public review and comment for 45 days, in a manner calculated to obtain broad based participation from individuals, businesses, Indian tribes, and non-profit organizations; and,
WHEREAS, on December 11, 2017, the St. Charles Parish Council adopted Resolution No. 6320 approving the initial MIP; and,
WHEREAS, as additional RESTORE Act funds become available under the Direct Component, and as additional projects are proposed for funding, this MIP will be amended to include those projects and made available for public comment and review in accordance with Treasury’s requirements; and,
WHEREAS, the attached draft MIP Amendment #1 has undergone a 45-day public comment period from September 5 - October 21, 2024; and,
WHEREAS, no meaningful comments were received in response to the public notice; and,
WHEREAS, after completing the MIP process, St. Charles Parish must submit the complete information package to Treasury for review; and,
WHEREAS, after reviewing the MIP for completeness and conformity with Treasury regulations, Treasury will notify the Parish, in writing, that it may begin to submit grant applications to fund activities consistent with the MIP.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL AND THE PARISH PRESIDENT, do hereby adopt the St. Charles Parish RESTORE ACT Multiyear Implementation Plan Amendment #1 and approve the submission to the U.S. Department of the Treasury for their review and acceptance.
BE IT FURTHER RESOLVED that the Parish President is designated to submit the Multiyear Implementation Plan and any subsequent amendments to the U.S. Department of the Treasury and execute any and all documents necessary on behalf of St. Charles Parish.
