Title
An ordinance to amend the Code of Ordinances to not allow the construction of residential structures within 500 feet of a Railway Switching Yard.
Body
WHEREAS, Railway Switching Yard's create loud noises and vibrations which are disruptive to residential communities; and,
WHEREAS, residents living adjacent to railway yards have complained of vibrations affecting the slab's and walls of their homes; and,
WHEREAS, it is in the best interest of St. Charles Parish to prohibit residential construction within 500 feet of a Railway Switching Yard.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 20, Railroads, is hereby amended by adding the following:
"It shall be unlawful to construct a residential structure within 500 feet of a Railway Switching Yard."
SECTION II. A Railroad Switching Yard being defined as:
An area of land, a portion of which is covered by a system of four or more railroad tracks, that provides for the making up of trains by one or more railroads or private industry concerns. Necessary functions of a railroad switching yard include but are not limited to the classifying, switching, storing, assembling, distributing, consolidating, moving, repairing, weighing, or transferring of railcars, trains, engines, locomotives, and rolling stock.
