Title
An ordinance to approve and authorize the execution of a Department of the Army Easement for Phase V and VI of the East Bank Multi-Use Path along the upper and lower guide levees of the Bonnet Carre' Spillway (DACW29-2-15-42) in Norco.
Body
WHEREAS, the Parish desires to construct the Phase V and VI of the east bank multi-use paths along the Mississippi River and must cross the Bonnet Carre' Spillway; and,
WHEREAS, the Department of the Army, New Orleans District, Corps of Engineers has agreed to provide an easement across the Spillway for the construction of both Phase V and VI of the bike path; and,
WHEREAS, it is the desire of the Parish Council to approve a twenty five year easement for said project.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Department of the Army Easement for Multi-Use Paths located on Bonnet Carre' Spillway Project Tract No. 120, Section 2 Township 12 South, Range 8 East and Tract Nos. 100, 101, 102, and 103, Section 12 Township 12 South, Range 7 East, St. Charles Parish, Louisiana, No. DACW29-2-15-42 by and between the Secretary of the Army and St. Charles Parish for the above referenced Multi-Use paths is hereby approved.
SECTION II. That the Parish President is hereby authorized to execute said License.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this ______ day of __________, 2015, to become effective five (5) days after publication in the Official Journal.
