ORDINANCE NO. 03-5-8
Title
An ordinance to amend the Code of Ordinances, Section 21-1. to provide for the installation of culverts and permit fees.
Body
WHEREAS, the current Code of Ordinances provides for the installation of culverts within any public drainage ditch or canal; and,
WHEREAS, the Code requires that if a landowner wants to install culverts in the public drainage ditch adjacent to their property, they must acquire a culvert permit and other than for a driveway, hire a contractor to provide the installation; and,
WHEREAS, it is in the best interest of the Parish to encourage the installation of sub-surface drainage, to improve the drainage, safety and aesthetics of the Parish; and,
WHEREAS, if a landowner is willing to incur the expense of purchasing culverts, installing cleanout boxes and fill to cover the culverts, all in accordance with parish regulations, it is the desire of the Parish Council, through the Department of Public Works to provide for the installation of said culverts at the appropriate grade and elevation; and,
WHEREAS, any revenue derived from the issuance of said permits should be credited to the Road and Drainage Fund.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 21, Article I., Section 21-1., (a) (8) is hereby amended by deleting the current language and replacing it with the following:
(8) The Parish shall provide for the installation of culverts, upon issuance of the proper permit, provided all installations are made in accordance with these regulations. The Parish shall not provide cover material for culverts, other than the material dug from the ditch when the culverts are being installed. St. Charles Parish shall only install culverts which meet or exceed the Parish specifications.
SECTION II. That the Code of Ordinances, Chapter 21, Article I., Section 21-1., (b) Fees is hereby amended by deleting the last sentence and replacing it with the following:
"All permit fees collected shall be credited to the Road and Drainage Fund."
