Title

A resolution of the St. Charles Parish Council, authorizing the Parish President to execute any and all documents necessary to authorize Lafourche Basin Levee District, its contractors, assignees, designees and agents to access and enter property owned by St. Charles Parish within the Sunset Drainage District for the purpose of evaluating, designing, making, improving, constructing and enhancing the levees and/or portions thereof located therein or and for such terms and conditions as he deems appropriate for the Upper Barataria Risk Reduction Segment 2-Sunset Levee Lift, CPRA Project No. BA-0220.

Body

WHEREAS,                     the Lafourche Basin Levee District proposes to begin work and construction of the Upper Barataria Risk Reduction Segment-2-Sunset Levee Lift, CPRA Project No. BA-0220 (the “Project”); and,

WHEREAS,                     the work on the Project is to include the accessing and entering of certain property owned by St. Charles Parish within the Sunset Drainage District or over which St. Charles Parish has rights-of-way and servitudes for the purpose of evaluating, designing, making, improving, constructing and enhancing the levees or portions thereof on said property and rights-of-way and servitudes; and,

WHEREAS,                     the Lafourche Basin Levee District has requested that St. Charles Parish authorize it to enter its property and rights-of-way and servitudes within the Sunset Drainage District for purposes of performing the construction and the work on the Project; and,

WHEREAS,                     in addition to other things, the project will include the placement of fill on the crown of the various levees within the Sunset Drainage District to achieve design height for interim protection.

THE ST. CHARLES PARISH COUNCIL, HEREBY ORDAINS:

                     SECTION I.                     That Matthew Jewell, St. Charles Parish President, is hereby authorized to execute any and all documents necessary to allow the Lafourche Basin Levee District, its contractors, assignees, designees and agents to access and enter property owned by St. Charles Parish within the Sunset Drainage District for the purpose of evaluating, designing, making, improving, constructing and enhancing the levees and/or portions thereof located therein on such terms and conditions as he deems appropriate, for the Upper Barataria Risk Reduction Segment-2-Sunset Levee Lift, CPRA Project No. BA-0220.

The foregoing resolution having been submitted to a vote, the vote thereon was as follows:

 

 

 

 

And the resolution was declared adopted this             day of                       , 2022, to become effective five (5) days after publication in the Official Journal.
