Title
A resolution ordering and calling an election to be held in the Parish of St. Charles, State of Louisiana, to authorize the amendment of Section A of Article III of the St. Charles Parish Home Rule Charter.
Body
WHEREAS,      this Parish Council adopted an ordinance on                                  , proposing that an amendment to Section A of Article III of the St. Charles Parish Home Rule Charter be submitted to the electorate of St. Charles Parish and ordering that a resolution be adopted calling the said election; and,
WHEREAS,      the proposals for amending Section A of Article III shall read as follows:
            PROPOSAL I.
                  ARTICLE III.
                  SECTION A.  THE GOVERNING AUTHORITY
                  1.a.      The name of the governing authority….
                        which shall consist of ten (10) members….
  1. Eight (8) members shall be elected…
  2. 3.a.      There shall be eight (8) Parish Council Districts.
                  5.d.      ….Six (6) members of the Council shall constitute a quorum….affirmative vote by at least six (6), except where a two-thirds vote is required in which event at least seven (7) favorable votes are necessary…
                  6.c.iv.      Any vacancy occurring on any agency….shall be filled within thirty days by vote of at least six members of the Parish Council.
            PROPOSAL II.
                  ARTICLE III.
                  SECTION A.  THE GOVERNING AUTHORITY
                  1.a.      The name of the governing authority….
                        which shall consist of eight (8) members….

3.a.      There shall be six (6) Parish Council Districts.
                  5.d.      ….Five (5) members of the Council shall constitute a quorum….affirmative vote by at least five (5), except where a two-thirds vote is required in which event at least six (6) favorable votes are necessary…
                  6.c.iv.      Any vacancy occurring on any agency….shall be filled within thirty days by vote of at least five members of the Parish Council.
WHEREAS,      this Parish Council now desires to call the election submitting the said proposed amendments to the electorate of St. Charles Parish.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, acting as the Governing Authority of the Parish of St. Charles, State of Louisiana:
      SECTION I.      That under the authority conferred by Article 6, Sections 5 and 22 of the Louisiana Constitution of 1974, Part IX, Chapter 2 of Title 39 and Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto, an election be and the same is hereby called and ordered to be held in the Parish of St. Charles, State of Louisiana, on Saturday, October 5, 2002, between the hours of six (6:00) o'clock a.m. and eight (8:00) o'clock p.m., in compliance with the provisions of Section 541 of Title 18 of the Louisiana Revised Statutes of 1950 (R.S. 18:541), and that at said election there shall be submitted to the resident electors of said Parish, qualified and entitled to vote at said election under the Constitution and laws of this State, the proposition set forth in the Notice of Election appearing in Section 2 of this resolution.
      SECTION II.      That there shall be published in the Official Journal being a weekly newspaper published in St. Charles Parish and a newspaper of general circulation in the Parish of St. Charles, State of Louisiana, for forty-five (45 clear days in accordance with law, notice of said election, which notice shall be substantially in accordance with the Notice of Election annexed hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.
      SECTION III.      That this Parish Council, acting as the governing authority of said Parish, shall meet at the Council Chambers, Courthouse, Hahnville, Louisiana, on Monday, November 4, 2002 at six (6:00) o'clock p.m., and shall then and there in open and public session proceed to examine and count the votes, examine and canvass the returns and declare the results of said election.
      SECTION IV.      That the polling places set forth in the aforesaid Notice of Election and situated within the corporate limits of said Parish, be and the same are hereby designated as the polling places at which to hold said election.  The Commissioners and Commissioners-in-charge designated to serve said polling places shall be the Commissioners and Commissioners-in Charge designated according to the election of the State of Louisiana to serve said polling places for the conduct of the said election to be held on October 5, 2002, and shall be compensated in accordance with law.
      SECTION V.      That the officers above designated, or such substitutes therefor as may be selected and designated in compliance with law, shall hold the said election to conform with the provisions of the foregoing constitutional and statutory authority, and shall make due returns of the said election for the meeting of said Parish Council to be held at the Council Chambers, Courthouse, Hahnville, Louisiana on Monday, November 4, 2002, at six (6:00) o'clock p.m.  Voting machines shall be used and all qualified electors of said Parish shall be entitled to vote.
      SECTION VI.      That the Parish President be and he is hereby empowered, authorized and directed to arrange for and to furnish to the said election officers, in ample time for the holding of said election, the necessary equipment, forms and other election paraphernalia essential to the proper holding of said election.
      SECTION VII. That copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of St. Charles, Louisiana, and the Registrar of Voters in and for the said Parish, as notification of the election herein called in order that such may prepare for said election and perform their respective functions as required by law.

      Pursuant to the provisions of a resolution adopted by the St. Charles Parish Council, acting as the governing authority of the Parish of St. Charles, State of Louisiana, on                               , NOTICE IS HEREBY GIVEN that an election will be held in the Parish of St. Charles, State of Louisiana, on Saturday, October 5, 2002, and at said election there will be submitted to the electors of said Parish qualified and entitled to vote at said election under the Constitution and laws of this State, the following propositions, to-wit:

      The above proposed amendment shall be adopted when approved by a majority of the electors voting thereon and shall become effective on the second Monday of the second month following the general election to be held in 2003.

      The said election will be held in accordance with the provisions of Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto, and the officers appointed to hold the said election, or such substitutes therefor as may be selected and designated in compliance with law, will make due returns thereof to the St. Charles Parish Council. Voting machines will be used and all qualified electors in the Parish of St. Charles shall be entitled to vote in this election.
      NOTICE IS HEREBY GIVEN that said Parish Council will meet at the Council Chambers, Courthouse, Hahnville, Louisiana, on Monday, November 4, 2002, at Six o'clock (6:00) p.m., and will then and there in open and public session proceed to examine and count the votes, examine and canvass the returns, and declare the results of said election.
