Title
An ordinance of the Parish of St. Charles providing that the Code of Ordinances, Parish of St. Charles, be amended by revising Appendix C, the St. Charles Parish Subdivision Regulations of 1981, of said Code; providing that requirements for Preliminary Plat approval shall include the Parish Council.
Body
WHEREAS,      any subdivider, developer, or development group seeking to subdivide or develop land in St. Charles Parish must, when required, submit for approval a formal preliminary plan; and,
WHEREAS,      provisions of the existing law require approval of the Preliminary Plan of both the Department of Planning and Zoning and the Planning Commission prior to construction of subdivision improvements; and,
WHEREAS,      upon completion of construction improvements the subdivder is required to submit the Final Plat for approval to the Council.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.    That Appendix C, the St. Charles Parish Subdivision Regulations of 1981, shall be amended to read as follows:
II.B.4.e.      Public Hearing/Decision Process.  The subdivider or his representative shall be present at the public hearing to explain the proposal and to answer questions.  Following the public hearing, the Commission shall recommend either:
(1)      Approval of the Preliminary Plat as submitted.
(2)      Conditional approval of the Preliminary Plat with conditions stated in writing.
(3)      Disapproval of the Preliminary Plat within sixty (60) calendar days of the date of the public hearing unless the time is extended by mutual agreement between the Commission and the subdivider.
The reason(s) for recommending disapproval shall be stated in writing to the subdivider.  Recommendations for approval or conditional approval shall be evidenced by the Commission Chairman's signature on the Preliminary Plat.  Any recommended conditions or requirements shall be referenced and attached to the Preliminary Plat and application.  The Commission, through the Department of Planning and Zoning, shall notify the Parish President and the Parish Council of the recommendation regarding the Preliminary Plat.  The Parish Council shall schedule a Public Hearing on the proposed subdivider.  Approval or conditional approval of the Parish Council shall be valid for a period of six (6) months from the date of the Commission decision, unless extended by the Commission.  Preliminary Plat approval of any successive phase of an approved subdivision expires when construction is interrupted on any such phase for a period of six (6) months or more.
      II.D. Subdivision Construction
            1.      Procedure.  After receiving Council approval…
      III.A.1.c.      …The Planning Commission Chairman shall also sign and date the described documents so as to evidence prior recommended Preliminary Plat approval of the subdivision in question.
      IV.D.5.      Drainage Impact Analysis.  Drainage studies shall be required pursuant to the following requirements.  A comprehensive drainage impact analysis of all proposed subdivision and surrounding affected areas must be submitted to the Planning Commission and Parish Council by a Licensed Professional Engineer registered with the State of Louisiana.  Neither the subdivision Preliminary Plat nor subdivision construction prints will be approved until a favorable written certification of the drainage impact analysis has been made by the office of the Director of Public Works.  If the Council gives Preliminary approval to a plat contingent on later submission of the drainage analysis and if this drainage impact analysis is found to indicate improper drainage will result because of the subdivision, then the plat shall be returned to the Council for reconsideration at its next scheduled meeting.  Until the developer has developed a drainage plan that is acceptable to the Director of Public Works, the Preliminary Plat shall not be approved.
NOW, THEREFORE BE IT ORDAINED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby provide that the Code of Ordinances, Parish of St. Charles, be amended by revising Appendix C, the St. Charles Parish Subdivision Regulations of 1981, of said Code; providing that requirements for Preliminary Plat approval shall include the Parish Council.
