Title
A resolution waiving the five hundred foot (500’) distance requirement from a protected organization and allowing the Department of Planning & Zoning to issue zoning clearance for the retail sale of pre-packaged alcoholic beverages intended for off-site consumption for KS Discount Express, located at 12139 Highway 90, Luling, as requested by Fouad Azaar.

WHEREAS, upon approval of Ordinance 24-9-7, the St. Charles Parish Code of Ordinances, Chapter 3, Section 3-1(a)(3) permits the St. Charles Parish Council to consider waiving the 500' distance requirement for retail sales of pre-packaged alcohol intended for off-site consumption; and,
WHEREAS, the location of KS Discount Express at 12139 Highway 90, Luling is within 500 ft. of a protected organization, the West Regional Library at 105 Lakewood Drive, Luling; and,
WHEREAS, the Parish Council may consider the waiver when the applicant has submitted a completed application and a statement in writing from affected protected organization(s) waiving opposition to the zoning clearance and issuance of an alcohol license; and,
WHEREAS, the applicant submitted their zoning clearance application dated October 9, 2024, and the St. Charles Parish Library Board of Control waived their opposition as per their letter dated November 25, 2024.
NOW, THEREFORE, BE IT RESOLVED THAT THE ST. CHARLES PARISH COUNCIL, hereby waive the 500’ distance requirement from KS Discount Express, located at 12139 Highway 90, Luling, to the protected use in the area: The West Regional Library located at 105 Lakewood Drive, Luling.
BE IT FURTHER RESOLVED, that the Department of Planning & Zoning shall issue a letter of locational compliance for an alcohol license for KS Discount Express, so that the owner may request an alcoholic beverages business permit through the St. Charles Parish Sheriff.
The foregoing resolution having been submitted to a vote, the vote thereon was as follows:
