Title
An ordinance to amend the St. Charles Parish Code of Ordinances, Appendix C of the Subdivision Regulations, Section III.A.2.a., Section III.A.2.b., Section IV.D.2., and Section IV.D.2.b., concerning subsurface drainage for subdivision streets.
Body
WHEREAS,      the Subdivision Regulations stipulates that either open-swale or subsurface drainage are required for subdivision drainage; and,
WHEREAS,      open-swale drainage systems receive more trash and other debris than subsurface drainage systems; and,
WHEREAS,      maintenance of open-swale drainage systems is more frequent than for subsurface drainage due to erosion; and,
WHEREAS,      efficient drainage flow is impeded as a result of having to remove debris from parish intakes; and,
WHEREAS,      maintenance of the parish intakes is more demanding if there is more trash and other debris to clear; and,
WHEREAS,      efficient drainage of subdivisions requires that drainage ditches function with minimal obstructions; and,
WHEREAS,      It is the desire of the St. Charles Parish Council that drainage ditches function efficiently.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.  That the St. Charles Parish Code of Ordinances, Appendix C, Section III.A.2.a. is hereby amended as follows ;
a.      Arterial. In curb and gutter subsurface drainage subdivisions, the requirement shall be eighty (80) feet for two-lane roadways and one hundred (100) feet for four-lane roadways. If a waiver to the required subsurface design is obtained, the requirement for open-swale designed subdivisions shall be seventy (70) feet for two-lane roadways and one hundred (100) feet for four-lane roadways.
SECTION II.  That the St. Charles Parish Code of Ordinances, Appendix C, Section III.A.2.b. is hereby amended as follows ;
b.      Collector and Local. In curb and gutter subsurface drainage subdivisions, the requirement shall be fifty (50) feet. If a waiver to the required subsurface design is obtained, the requirement for open-swale designed subdivisions shall be sixty (60) feet.
SECTION III.  That the St. Charles Parish Code of Ordinances, Appendix C, Section IV.D.2. is hereby amended by inserting the following ;
2.      Roadside Drainage. All roadside drainage shall be of subsurface or open-swale design. The roadside drainage system shall be designed to carry roadway, adjacent land, and structural storm water drainage. Requests for Waiver of Subsurface Drainage Requirement. Waiver of the requirement for subsurface design shall be by formal letter written to the Director of Planning & Zoning. This letter shall contain a specific reference to the request and state the reasons that the request be granted. The Planning & Zoning Commission, with a supporting resolution of the Parish Council, may grant a waiver only when letters of acceptance from the Directors of Public Works and Wastewater, and Planning & Zoning are submitted to the Commission.
SECTION IV.  That the St. Charles Parish Code of Ordinances, Appendix C, Section IV.D.2.b. is hereby amended by inserting and deleting the following):
b.      Open-Swale Drainage. When open-swale drainage is the chosen drainage method If a waiver to the requirement for subsurface drainage is obtained, the following design standards shall be met:
