Title
An ordinance to amend the Code of Ordinances, Appendix A. St. Charles Parish Zoning Ordinance of 1981, Section XX. Flood Damage Prevention, D. Administration, 5. Variance Procedures, b. Conditions for Variances, by interjecting an additional subsection as Subsection 8, and renumbering existing Subsection 8 as Subsection 9.
Body
WHEREAS, the Zoning Board of Adjustments, as established by St. Charles Parish, shall hear and decide appeals and requests for variances from the requirements of this Ordinance; and,
WHEREAS, variances may be issued for new construction and substantial improvements to be erected on designated lots; and,
WHEREAS, it is the intention of the St. Charles Parish Council to have final approval on all variances to the Advisory Base Flood Elevations which are granted by the Zoning Board of Adjustment; and,
WHEREAS, upon approval of the supporting Resolution by the St. Charles Parish Council, the variance shall become effective.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Appendix A, Section XX. Flood Damage Prevention, D. Administration, 5. Variance Procedure, b. Conditions for Variances, shall be amended by interjecting an additional subsection as Subsection 8, and renumbering existing Subsection 8 as Subsection 9.
SECTION II. That Subsection 8. shall read as follows:
8. Any variance to the Advisory Base Flood Elevations granted by the Zoning Board of Adjustment shall require a supporting Resolution by the Council for it to become effective.
SECTION III. That existing Subsection 8 shall become Subsection 9, and Subsection 9 shall read as follows:
9. Any applicant to whom a variance is granted shall be given written notice that the structure will be permitted to be built with the lowest floor elevation below the base flood elevation, and that the cost of flood insurance will be commensurate with the increased risk resulting from the reduced lowest floor elevation.

And the ordinance was declared adopted this day of , 2012, to become effective five (5) days after publication in the Official Journal.
