Title
An ordinance to approve and authorize the execution of Department of the Army License No. DACW29-2-16-19 (Easement) to allow the continued maintenance of an existing drainage ditch parallel to the East Guide Levee of the Bonnet Carre’ Spillway Norco.
Body
WHEREAS, the Department of the Army License No. DACW29-3-11-128 was issued by the U. S. Army Corps of Engineers for the improvement and maintenance of an existing drainage ditch, parallel to and outside of the East Guide Levee of the Bonnet Carre’ Spillway Project; and,
WHEREAS, said license was for a period of five (5) years from May 1, 2011 through April 30, 2016; and,
WHEREAS, the U. S. Army Corps of Engineers has proposed to renew said License by issuing Department of the Army License No. DACW29-2-16-19 for a term of fifty (50) years, May 1, 2015 through April 30, 2065; and,
WHEREAS, it is the desire of the Parish Council to approve said License renewal.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Department of the Army License No. DACW29-2-16-19 for continued maintenance of an existing drainage ditch parallel to the East Guide Levee of the Bonnet Carre’ Spillway in Norco is hereby approved and accepted.
SECTION II. That the Parish President is hereby authorized to execute said License on behalf of St. Charles Parish.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this day of , 2016, to become effective five (5) days after publication in the Official Journal.
