Title

An ordinance to amend the St. Charles Parish Code of Ordinances, Appendix A, Zoning Ordinance of 1981, Section X. Exceptions and modifications, G. Exceptions and Modifications to all Provisions for Construction and/or Operation of Cellular and Personal Communication Service Installations within the Parish of St. Charles, State of Louisiana, 1. Permit Requirements/Zoning Districts. a. Special Permit Use.

Body

WHEREAS,                     the St. Charles Parish Zoning Ordinance of 1981 defines a co-location as “Locating wireless communications equipment from more than one (1) provider on one (1) site” (Section III); and,

WHEREAS,                     Section X.G.2.b of the Zoning Ordinance requires cellular and PCS monopoles and towers to allow co-location; and,

WHEREAS,                     Section X. G.1.a of the Zoning Ordinance suggests that each co-location on a monopole or transmission tower requires the same Special Permit process as the tower itself, even if the tower does not require enhancements to provide for the co-location (Section X. G. 1.a); and,

WHEREAS,                     the Special Permit Use process is excessive for a co-location and may serve to discourage rather and encourage co-location; and,

WHEREAS,                     the Special Exception process requires a thorough administrative review that should be sufficient to permit the co-location of additional providers on existing monopoles and transmission towers when the tower does not require enhancements to provide for the co-location; and,

WHEREAS,                     any monopole or tower that requires structural enhancements to accommodate a co-location will require a new Special Permit,

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

                     SECTION I.                     That the St. Charles Parish Zoning Ordinance of 1981, Appendix A, Section X. Exceptions and modifications, G. Exceptions and Modifications to all Provisions for Construction and/or Operation of Cellular and Personal Communication Service Installations within the Parish of St. Charles, State of Louisiana, 1. Permit Requirements/Zoning Districts. a. Special Permit Use is amended as follows, with additional text in bold and deleted text in strikethrough:

“The co-location of new Cellular/PCS facilities on an existing tower/structure may be permitted as a Special Permit Exception Use in any zoning district when the addition of such facilities does not require the structural modification of the primary supporting tower structure.”

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
