An ordinance to amend the St. Charles Parish Code of Ordinances, Chapter 12. Libraries, by adding Section 12-4. Library Board of Control, to reorganize the St. Charles Parish Library Board of Control to increase the membership of the Board to seven (7) regular members to establish representation from each of the seven (7) council districts.

WHEREAS, the Governing Authority of St. Charles Parish established the St. Charles Parish Public Library on November 9, 1948; and,
WHEREAS, Louisiana Revised Statute, 25:214 (B) mandates that the governing authority of the parish shall, in the ordinance creating a public library, name and appoint, at its option, not less than five citizens nor more than seven citizens of the parish as a board of control for such parish library to serve for terms of one, two, three, four, and five years, the successors of whom shall each be appointed for a term of five years; and,
WHEREAS, on April 1, 1955, the Governing Authority of St. Charles Parish appointed five (5) citizens, one (1) from each ward to serve as members of the St. Charles Parish Library Board of Control; and,
WHEREAS, on December 28, 1978, the Governing Authority of St. Charles Parish adopted Ordinance No. 66-3-447 to reapportion the Parish of St. Charles into seven Parish Council Districts, and;
WHEREAS, the Parish Council feels it is in the best interest of the citizens for each district to have representation on the Library Board of Control; and,
WHEREAS, it is the desire of the Parish Council to allow the existing members of the Library Board of Control to continue to serve out the remainder of their current terms, with each member being designated herein as their respective District representative.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Chapter 12 of the St. Charles Parish Code of Ordinances be amended by adding Section 12-4. to read as follows:
Section 12-4. Library Board of Control
The Board shall consist of seven (7) regular members, one (1) member from each parish council district, all of whom shall be a qualified voter of St. Charles Parish. Any District or At-large councilmember may nominate a representative for any vacant district appointment; nominee must reside within the district of the vacancy.
The Chairman of the Parish Council shall be ex officio, a member of the Board of Control for such public library, provided however that the Chairman of the Parish Council shall have the right to designate another member of the governing authority of the parish to serve in his place on the Board of Control of such public library.
The Library Board of control members appointed pursuant to this Section shall be appointed to serve a term of five (5) years, except that a vacancy occurring otherwise than by the expiration of his term shall be filled for the unexpired term in the same manner as the original appointment. An appointment to fill a vacancy for an unexpired term shall not constitute a full term. Members shall serve for no more than two (2) consecutive terms.
SECTION II. That the increase in the number of board members provided for herein, from 5 to 7, shall be effective August 1, 2014.
SECTION III. That the following designations are hereby made for the respective districts established herein:
District I, Mr. Ralph DeRoche, Jr., current term to expire April 1, 2015.
District II, Mr. Robert Faucheux, current term to expire April 1, 2016.
District III, Vacant, term effective August 1, 2014 to expire August 1, 2019.
District IV, Vacant, term effective August 1, 2014 to expire August 1, 2019.
District V, Ms. Tammy Windmann, current term to expire April 1, 2019.
District VI, Vacant, unexpired term of Jarvis Lewis, term effective upon appointment to expire April 1, 2017.
District VII, Ms. Celeste Uzee, current term to expire April 1, 2018.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:

NAYS: NONE
ABSENT: BENEDETTO
And the ordinance was declared adopted this 16th day of June , 2014, to become effective five (5) days after publication in the Official Journal.
