A resolution opposing HB898, HB862, SB407, SB579, SB469, HB855, SB531, SB546, HB148, HB881, and HB408 as the bills would adversely affect St. Charles Parish operations, revenue, and authority to perform its functions as a local governing authority.

WHEREAS,      HB 898 provides for two additional members of the Port of South Louisiana Commission to be appointed by the Governor; and,
WHEREAS,      HB 862 provides for a process for initiation or continuation of actions by local government subdivisions to initiate or continue actions to enforce the coastal management program and has already been officially opposed by the Louisiana Parishes Against Coastal Erosion (LA PACE); and,
WHEREAS,      SB 407 provides for preemptions against a local governing authority, municipality, parish, or other local governmental entity enacting, adopting, or enforcing an ordinance, law, or regulation regarding hazardous materials reporting or any provision of the Right-to-Know Law; and,
WHEREAS,      SB 579 provides that no taxing authority shall levy or collect a sales tax on the sale at retail of asphalt used, consumed, or processed into tangible property; and,
WHERAS,      SB 469 and HB 855 provides for a process for initiation or continuation of actions by local governmental subdivisions to enforce the coastal management plan and has already been officially opposed by LA PACE; and,
WHEREAS,      SB 531 provides relative to the authority of certain state and local government entities to bring causes of action arising from or related to certain permits issued in the coastal area; and,
WHEREAS,      SB 546 provides relative to preemption of civil actions against certain permittees of the state; and,
WHEREAS,      HB 148 is a constitutional amendment that could require that monies that would otherwise go directly to the Parishes would be deposited into the Coastal Protection & Restoration Fund; and,
WHEREAS,      HB 881 provides for certain stipulations and requirements to be placed on the Parishes receiving RESTORE Act funds and has already been officially opposed by LA PACE; and,
WHEREAS,      HB 408 gives the legislative auditor authority to audit, review the books and accounts of local government for any year in which entity receives or expends funds relative to Deep Water Horizon oil spill, including RESTORE Act funds; and,
WHEREAS,      the St. Charles Parish Council, acting as the governing authority of the Parish of St. Charles desires to oppose HB898, HB862, SB407, SB579, SB469, HB855, SB531, SB546, HB148, HB881, and HB408 as the Council believes it to be in the best interest of the people of St. Charles.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby oppose HB898, HB862, SB407, SB579, SB469, HB855, SB531, SB546, HB148, HB881, and HB408 as the bills would adversely affect St. Charles Parish operations, revenue, and authority to perform its functions as a local governing authority and request the Parish President or his designee to take any actions necessary to achieve the spirit of this resolution.
