Title
An ordinance to amend Ordinance No. 91-5-16 as subsequently amended in order to more fully describe precinct divisions approved as part of the St. Charles Parish Council 2000 reapportionment plan adopted, pursuant to Ordinance No. 01-12-06.
Body
WHEREAS, on May 14, 1991, the St. Charles Parish Council adopted Ordinance No. 91-5-16 which established and defined the St. Charles Parish 1990 Visible Precinct Boundaries in accordance with the then current State law; and,
WHEREAS, subsequent amendments thereto did further amend the boundaries of Precincts 3-4 and 6-6 the most recent of which was Ordinance No. 98-9-14 adopted on September 21, 1998 pursuant to Act 1420 of the 1997 Louisiana Legislature (La.R.S. 18:532.1(B)) in order to provide for visible precinct boundaries in anticipation of the 2000 Census; and,
WHEREAS, on December 3, 2001, the St. Charles Parish Council adopted Ordinance No. 01-12-6, which established and defined the St. Charles Parish 2000 Reapportionment Plan in accordance with La.R.S. 33:1411 and the St. Charles Parish Home Rule Charter, Article III, Section 3; and,
WHEREAS, whereas the 2002 Reapportionment Plan provided for the division of Precincts 3-4 and 6-6; and,
WHEREAS, the Parish desires to provide a written description of the previously approved precinct splits.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 91-5-16 as subsequently amended by Ordinance No. 98-9-14 is hereby amended by deleting the current descriptions for Precincts 3-4 and 6-6 and replacing each with a new description and by adding descriptions for three new precincts to be numbered 6-8, 3-5 and 3-6 as follows:
Precinct 3-4
Beginning at the intersection of the centerline of the Mississippi River and the centerline extension of Vans Lane; thence proceeding northeasterly along the extension of Vans Lane to its intersection with an unnamed road, thence southerly, southeasterly, easterly, northeasterly and easterly along said road to its intersection with La. Hwy. 48; thence southerly along La. Hwy. 48 to its intersection with Carolyn Drive; thence, northeasterly along the centerline of Carolyn Drive to its intersection with the centerline of the Illinois Central Gulf Railroad and River Point Drive; thence, southeasterly along the centerline of the Illinois Central Gulf Railroad to its intersection with the centerline of Ormond Blvd.; thence southwesterly along the centerline of Ormond Blvd. and its centerline extension to its intersection with River Road (Louisiana State Highway 48); thence northerly along River Road (Louisiana State Highway 48) to its intersection with River Point Drive; thence northeasterly along River Point Drive to its intersection with the Illinois Central Gulf Railroad tracks, the centerline of the Mississippi River; thence northwesterly along the centerline of the Mississippi River to its intersection with the centerline extension of Vans Lane, the point of beginning.

New Precinct 6-8 (formerly part of 3-4)
Beginning at the intersection of the centerline of the Mississippi River and the centerline extension of Vans Lane; thence proceeding northeasterly along the extension of Vans Lane to its intersection with an unnamed road, thence southerly, southeasterly, easterly, northeasterly and easterly along said road to its intersection with River Road (Louisiana State Highway 48); thence southerly along River Road (Louisiana State Highway 48) to its intersection with Carolyn Drive; thence, northeasterly along the centerline of Carolyn Drive to its intersection with the centerline of the Illinois Central Gulf Railroad; thence, southeasterly along the centerline of the Illinois Central Gulf Railroad to its intersection with the centerline of River Point Drive; thence southwesterly along River Point Drive to its intersection with River Road (Louisiana State Highway 48); thence southerly along River Road (Louisiana State Highway 48) to its intersection with the extension of Schexnaydre Lane; thence southwesterly along the extension of Schexnaydre Lane to its intersection with the centerline of the Mississippi River; thence northerly along the centerline of the Mississippi River to its intersection with the extension of Van's Lane, the point of beginning.

Precinct 6-6
Beginning at the intersection of the center flow channel of the Mississippi River and the centerline of the straight line extension of Clement Street; thence, northeasterly along the centerline of the straight line extension of Clement Street and Clement Street to its intersection with the centerline of Short Street; thence, northwesterly along the centerline of Short Street to its intersection with the centerline of Annex Street; thence, northeasterly along the centerline of Annex Street to its intersection with the centerline of the Illinois Central Gulf Railroad; thence, southeasterly along the centerline of said railroad to its intersection with the centerline of Trosclair Canal; thence, northeasterly along the centerline of Trosclair Canal to its intersection with the centerline of U.S. Hwy. 61; thence, southeasterly along the centerline of U.S. Hwy. 61 to its intersection with a levee system that is parallel to Villere Drive; thence, southwesterly, southeasterly and southwesterly along said levee system and the levee system behind Ormond Trace Subdivision to its intersection with the a power transmission line (Tiger Line ID: 15717607); thence southeasterly along said power transmission line to its intersection with Schexnaydre Drive; thence southwesterly along Schexnaydre Drive to its intersection with Plantation Road; thence northwesterly along Plantation Road to its intersection with Acadia Lane; thence southwesterly along Acadia Lane to its intersection with the centerline of the Illinois Central Gulf Railroad; thence, northwesterly along the centerline of said railroad to its intersection with the centerline of Vans Lane; thence southwesterly along Vans Lane to its intersection with W. Railroad Street; thence, northwesterly along W. Railroad Street to its intersection with W. Lawson Street; thence, southwesterly along the centerline W. Lawson Street to its intersection with the centerline of Park Avenue; thence, westerly along the centerline of Park Avenue to its intersection with River Road (Louisiana State Highway 48); thence, southerly along the centerline of the River Road (Louisiana State Highway 48) to its intersection with Vans Lane; thence, southwesterly along Vans Lane and its extension to its intersection with the center flow channel of the Mississippi River; thence, northerly along the center flow channel of the Mississippi River; to its intersection with the centerline of the straight line extension of Clement Street; the point of beginning.

Beginning at the intersection of Plantation Road and Schexnaydre Lane; thence northwesterly along Plantation Road to its intersection with Acadia Lane; thence southwesterly along Acadia Lane and its extension to its intersection with the Illinois Central Gulf Railroad tracks; thence southeasterly along the Illinois Central Gulf Railroad tracks to its intersection with Schexnaydre Lane; thence northeasterly along Schexnaydre Lane to its intersection with Plantation Road, the point of beginning.
Polling Place: Destrehan High School, 1 Wildcat Drive, Destrehan
New Precinct 3-6 (formerly part of 6-6)
Beginning at the intersection of a power transmission line (Tiger Line ID: 15717607) and Schexnaydre Lane; thence northwesterly along said power transmission line to its intersection with a levee behind Ormond Trace Subdivision; thence northeasterly along said levee to its intersection with a levee parallel to Villere Drive; thence southeasterly and southwesterly along said Levee to its intersection with a power transmission line and Schexnaydre Drive, the point of beginning.

SECTION II. That the provisions of this ordinance shall become effective upon "preclearance" by the United States Department of Justice, as required under Section 5 of the Voting Rights Act of 1965, as amended.
SECTION III. If any section, part, paragraph, sentence, or clause of this ordinance should be declared invalid or unenforceable, such invalidity or defect shall not affect the remaining sections, paragraphs, parts, sentences, or clauses hereof and, to this end, the several provisions hereof are hereby declared severable.
SECTION IV. All Ordinances or parts thereof in conflict herewith are hereby repealed.
