Title
An ordinance to rescind Ordinance No. 10-9-4 and to approve and authorize a property Lease Agreement between Goodwill Industries of Southeastern Louisiana, Inc., and the Parish of St. Charles for a Business Incubator at 917 Third Street in Norco.
Body
WHEREAS, the Parish of St. Charles, State of Louisiana, is authorized and empowered under the laws of the State of Louisiana, including particularly Section 4717.2 of Title 33 of the Louisiana Revised Statutes of 1950 to lease property to further its purposes of promoting and encouraging industrial and commercial development; and,
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 07-9-2 on September 4, 2007 approving a property Lease Agreement between River Parishes Community Development Corporation and the Parish of St. Charles for a Business Incubator at 917 Third Street in Norco; and,
WHEREAS, River Parishes Community Development Corporation requested that the Parish of St. Charles transfer their interest in said Lease to Goodwill Industries of Southeastern Louisiana, Inc.; and,
WHEREAS, the St. Charles Parish Council adopted Ordinance No. 10-9-4 which transferred the interest of said Lease to Goodwill Industries of Southeastern Louisiana, Inc.; and,
WHEREAS Ordinance No. 10-9-4 does not include terms Goodwill Industries of Southeastern Louisiana, Inc., and St. Charles Parish deemed necessary to fulfill project obligations; and,
WHEREAS, it is the desire of the St. Charles Parish Council to rescind Ordinance No. 10-9-4; and,
WHEREAS, pursuant to and in accordance with the provisions of the Act and a Facilities Lease by and between the Parish of St. Charles (the "Landlord") and Goodwill Industries of Southeastern Louisiana, Inc., (the "Tenant"), the Parish will rent certain property located at 917 Third Street in Norco, more fully described in the Facilities Lease, for the operation of the Tenant's business incubator program; and,
WHEREAS, it is the intent that this Facilities Lease supersedes Ordinance No. 07-9-2.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Ordinance No. 10-9-4 is hereby rescinded.
SECTION II. That the Lease Agreement between the Parish of St. Charles and Goodwill Industries of Southeastern Louisiana, Inc., for property located at 917 Third Street, Norco is hereby approved.
SECTION III. That the Parish President is hereby authorized to execute said Lease Agreement.
