Title
An ordinance of the Parish of St. Charles, providing that the Code of Ordinances, Parish of St. Charles, be amended by revising Chapter 19 Planning and Development, Article I. In General, Section 19-1. Planning and Zoning Commission, (b), to add term limits on Council appointments to the Planning and Zoning Commission.
Body
WHEREAS, Article III, Section A.7.c.x authorizes the Parish Council to provide budgetary, fiscal, and other controls over all special boards, commissions, agencies, districts, or any device having governmental functions which it or its predecessor has created to insure the maximum coordination of government at the local level in St. Charles Parish; and,
WHEREAS, in following with the ethical reform by the State of Louisiana in relative to term limits for members of certain Boards and Commissions; and,
WHEREAS, on November 4, 2008 election ballot, Proposed Constitutional Amendment No. 1 was overwhelmingly approved on the State level by 69% of the voters and on the Parish level by 69.41% of the voters; showing the voters of Louisiana believed in term limits; and,
WHEREAS, the St. Charles Parish Council desires to prohibit any person appointed to any Board or Commission from serving in such a position for more than a specified portion of a specified number of consecutive terms or for more than a specified number of consecutive years; and,
WHEREAS, St. Charles Parish Council desires to provide for a term limit on serving on the Planning and Zoning Commission.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That Chapter 19 Planning and Development, Article I. In General, Section 19-1. Planning and Zoning Commission, (b) is hereby amended by adding term limits on Council appointments as follows:
AS WRITTEN
(b) All members of the planning and zoning commission shall be appointed for a term of four (4) years from and after the expiration of the term of their predecessors in office and upon moving from their appointed district during their term; must resign from their appointed position.
REVISED
(b) All members of the Planning and Zoning Commission shall be appointed for a term of four (4) years from and after the expiration of the term of their predecessors in office and shall serve a maximum of two (2) consecutive terms, with the exception of members on the commission which may be serving a third term at the time of adoption of this ordinance. These members may continue to serve out the third term for which they were appointed. The time served by members appointed to fill a vacancy which completes the term of their predecessor shall not constitute a term. Members must resign from their appointed position should their residency change such that they no longer reside in the district for which they were appointed to represent.
