Title: A resolution requesting the Louisiana Attorney General to provide its opinion on what type of information, if any, is required to be included in full reports from the Planning and Zoning Commission to the Parish Council as required by code regarding the merits of proposed rezoning requests, to advise on the validity of any rezoning amendment approved by the Parish Council without having first received the required report which contains the type of information, if any, that the Attorney General advises is required to be included in the report from the Planning and Zoning Commission, and to provide its opinion as to the adequacy of the typical documentation received by the Parish Council regarding typical rezoning requests (documentation received with regards to PZR-2011-01 to be submitted as a typical example) with regards to the documentation containing, at a minimum, that which the report from the Planning and Zoning Commission is required to contain per Code.

Title

Body
WHEREAS,      Section XIV. Amendments and Petitions state that no rezoning amendment shall be effective unless the Council has received a full report from the Commission on the merits of the proposed amendment; and,
WHEREAS,      Section XV. Amendment procedure, A, states that no rezoning amendment shall be effective unless the Council has received a full report from the Commission on the merits of the proposed amendment; and,
WHEREAS,      Section XV. Amendment procedure, D, states that the Commission has 30 days in which to render a preliminary report upon the merits of the amendment; and,
WHEREAS,      the documentation received by the Parish Council prior to its consideration of a proposed rezoning has been questioned as to whether or not it contains what is required to contain per Parish codes.
NOW THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby request the Louisiana Attorney General to provide its opinion on what type of information, if any, is required to be included in full reports from the Planning and Zoning Commission to the Parish Council as required by code regarding the merits of proposed rezoning requests, to advise on the validity of any rezoning amendment approved by the Parish Council without having first received the required report which contains the type of information, if any, that the Attorney General advises is required to be included in the report from the Planning and Zoning Commission, and to provide its opinion as to the adequacy of the typical documentation received by the Parish Council regarding typical rezoning requests (documentation received with regards to PZR-2011-01 to be submitted as a typical example) with regards to the documentation containing, at a minimum, that which the report from the Planning and Zoning Commission is required to contain per Code.
