Title
A resolution to approve and authorize the execution of Amendment No. 1 to the Cooperative Endeavor Agreement by and between the Sunset Drainage District (Resolution No. 6104) and St. Charles Parish (Ordinance No. 14-10-10) to amend the transfer of property and the termination clause of said agreement.
Body
WHEREAS,      on October 6, 2014 the St. Charles Parish Council, acting as the Governing Authority of the Sunset Drainage District, adopted Resolution No. 6104 approving and authorizing the execution of a Cooperative Endeavor Agreement by and between St. Charles Parish and Sunset Drainage District; and,
WHEREAS,      on October 6, 2014 the St. Charles Parish Council adopted Ordinance No. 14-10-10 approving and authorizing the execution of a Cooperative Endeavor Agreement by and between St. Charles Parish and Sunset Drainage District; and,
WHEREAS,      said Cooperative Endeavor Agreement provides for the transfer of assets and property of the District to the Parish; and,
WHEREAS,      said Cooperative Endeavor Agreement provides for Termination of the Agreement for Cause; and,
WHEREAS,      it is the desire of the District and the Parish to amend said provisions of the Cooperative Endeavor Agreement.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE SUNSET DRAINAGE DISTRICT BOARD OF COMMISSIONERS, do hereby approve and accept Amendment No. 1 to the Cooperative Endeavor Agreement by between St. Charles Parish (Ordinance No. 14-10-10) and Sunset Drainage District (Resolution No. 6104).
BE IT FURTHER RESOLVED, that the Council Chairman, being the President of the Sunset Drainage District, is hereby authorized to execute said Amendment No. 1 to the Cooperative Endeavor Agreement on behalf of the Sunset Drainage District.
The foregoing resolution having been submitted to a vote, the vote thereon was as follows:
