Title
An ordinance to approve and authorize the execution of a Mitigation Participation Agreement by and between Coastal Louisiana Resource, LLC and the Parish of St. Charles for wetlands mitigation for the West Bank Hurricane Protection Levee - Phase III Ellington in the amount of $1,768,800.00.
Body
WHEREAS,      St. Charles Parish has undertaken the construction of the West Bank Hurricane Protection Levee Project - Phase III Ellington for providing comprehensive flood protection to protect the lives and property of the citizens of the West Bank of St. Charles Parish; and,
WHEREAS,      in order to fulfill the wetlands permitting requirements it is necessary to mitigate 16.4 acres of bottomland hardwood credits and 37.2 acres of cypress/tupelo swamp credits at the Bayou Terrebonne Coastal Mitigation Area located in Terrebonne Parish in the amount of $1,768,800.00; and,
WHEREAS,      it is the desire of the Parish Council to approve said Mitigation Participation Agreement to comply with the requirements of U. S. Army Corp of Engineers Permit No. MVN-2010-2326-EOO and Louisiana Department of Natural Resources Coastal Use Permit No. P20120821.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.      That the Mitigation Participation Agreement by and between Coastal Louisiana Resource, LLC and the Parish of St. Charles in the amount of $1,768,800.00 is hereby approved.
SECTION II.      That the Parish President is hereby authorized to execute said Mitigation Participation Agreement on behalf of the Parish of St. Charles.
