Title
A resolution opposing SB 467, SB 581, SB 667 and SB 263 as the bills would adversely affect St. Charles Parish operations, revenue, and authority to perform its functions as a local governing authority.
Body
WHEREAS,      SB 467 provides that if a party admits liability for environmental damage and a plan has been submitted to the Department of Natural Resources, the court shall not proceed to trial until the plan has been submitted to the Court and has already been officially opposed by the Louisiana Parishes Against Coastal Erosion (LA PACE); and,
WHEREAS,      SB 581 states that the plan approved by DNR for environmental damage remediation is the most feasible, limits remediation damage costs, and has already been officially opposed by the Louisiana Parishes Against Coastal Erosion (LA PACE); and,
WHEREAS,      SB 667 proposes the same as SB 581 except it also instructs the court to notify the jury of the presumption that the DNR approved plan is the most feasible and has already been officially opposed by the Louisiana Parishes Against Coastal Erosion (LA PACE); and,
WHEREAS,      SB 263 provides that residences with fewer than two dwellings shall be exempt from being required to install a backflow preventer; and,
WHEREAS,      the St. Charles Parish Council, acting as the governing authority of the Parish of St. Charles, desires to oppose SB 467, SB 581, SB 667 and SB 263 as the Council believes it to be in the best interest of the people of St. Charles.
NOW, THEREFORE, BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby oppose SB 467, SB 581, SB 667 and SB 263 as the bills would adversely affect St. Charles Parish operations, revenue, and authority to perform its functions as a local governing authority and request the Parish President or his designee to take any actions necessary to achieve the spirit of this resolution.
