ORDINANCE NO.                                                                

Title

An ordinance to approve and authorize the execution of Amendment No. 3 to Ordinance No. 99-9-25, an Intergovernmental Agreement with St. Charles Parish Law Enforcement District to increase the per day fee for the housing of local prisoners.

Body

WHEREAS,                     the St. Charles Parish Council adopted Ordinance No. 99-9-25 on September 20, 1999 approving an Intergovernmental Agreement between St. Charles Parish and the St. Charles Parish Law Enforcement District for the funding of the Correctional Center; and,

WHEREAS,                     said Agreement provided that the Parish would pay the Sheriff $20.00 per day for housing local pre-trial prisoners and prisoners sentenced to Parish time in the facility; and,

WHEREAS,                     on December 6, 2004 the St. Charles Parish Council adopted Ordinance No. 04-12-3 approving Amendment No. 1 by adjusting the per day rate from $20.00 to $22.39; and,

WHEREAS,                     on November 17, 2008 the St. Charles Parish Council adopted Ordinance No. 08-11-5 approving Amendment No. 2 by adjusting the per day rate from $22.39 to $24.39; and,

WHEREAS,                     Sheriff Greg Champagne has requested that the per day rate be increased to $30.00 per day; and,

WHEREAS,                     it is the desire of the Parish Council to approve said request.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     That Amendment No. 3 to Ordinance No. 99-9-25, adjusting the per day rate from $24.39 to $30.00 is hereby approved and accepted.

SECTION II.                     That the Parish President is hereby authorized to execute said Amendment No. 3 on behalf of St. Charles Parish.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
