Title
A resolution strongly requesting that the Parish President follows and uniformly enforces all code provisions relating to the permitting of trailers.
Body
WHEREAS, request was made to the Planning & Zoning Department for policy and procedure for permitting trailers; and,
WHEREAS, Planning & Zoning Department provided the policies and procedures; and,
WHEREAS, the policies and procedures were reviewed and the review indicated that some code related permitting requirements were not being followed; and,
WHEREAS, the skirting requirements for example is being violated; and
WHEREAS, the code must either be amended to make what is illegally being done legal or the code needs to be enforced; and,
WHEREAS, a proposed ordinance was presented to the Council on multiple occasions to make the illegal actions of the Administration legal with the latest consideration by the Council being on December 1, 2014; and,
WHEREAS, the Council has repeatedly elected not to approve the proposed ordinance to make the illegal activities legal; and,
WHEREAS, the failure of the Council pass an ordinance to make the illegal activity legal in effect tells the Parish President to continue the illegal activity; and,
WHEREAS, as Elected Officials of the legislative branch of our Parish government, the Council must either amend the code to make the illegal activity legal or must strongly request that the Administration cease the illegal activity and follow the existing codes; and,
WHEREAS, as Elected Officials, it is the Council's duty to provide checks and balances and to ensure that all codes are enforced, which in turn requires that we strongly request that the Parish President honor the oath of office which he swore to uphold to enforce amongst other things our parish codes.
NOW, THEREFORE BE IT RESOLVED, THAT WE, THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby strongly request that the Parish President follows and uniformly enforces all code provisions relating to the permitting of trailers.
The foregoing resolution having been submitted to a vote, the vote thereon was as follows:
And the resolution was declared adopted this day of , 2014, to become effective five (5) days after publication in the Official Journal.
