An ordinance to amend the Code of Ordinances Chapter 15, Motor Vehicles and Traffic, Section 15-5.1. Engine brake (“No Unmuffled Compression Brake”) (a) to add a “No Unmuffled Compression Brake” area on the I-310 down ramps at Highway 90 in Boutte.

WHEREAS,                     the practice of engine braking by diesel trucks (sometimes referred to as “Jake Brake”), creates disturbing, excessive and offensive noise when they are used; and,

WHEREAS,                     this problem has become a nuisance to the residents in the area on the I-310 down ramps at Highway 90 in Boutte; and,

WHEREAS,                     the location of where signs are to be placed noting the prohibition of the use of engine braking is shown on the drawings attached to and made a part of this ordinance; and,

WHEREAS,                     “UNMUFFLED COMPRESSION BRAKES PROHIBITED” signs shall be posted off each shoulder of I-310 in accordance with Louisiana Department of Transportation and Development requirements approximately 325 feet north of the overhead mounted signs on I-310 located just north of U. S. Highway 90.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     That the Code of Ordinances is hereby amended, in Section 15-5.1. Engine brake (“No Unmuffled Compression Brake”) (a) by adding the following:

It shall be unlawful for any driver of a truck or truck-tractor to activate or use the unit’s engine brake (“Unmuffled Compression Brake”), on the I-310 down ramps at Highway 90 in Boutte, except in an emergency situation.

                     The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:

YEAS:                     SCHEXNAYDRE, LEWIS, WILSON, WOODRUFF, BENEDETTO, HOGAN, COCHRAN, FISHER-PERRIER

NAYS:                     NONE

ABSENT:                     FLETCHER

                     And the ordinance was declared adopted this   6^th    day of      April ___, 2015 to become effective five (5) days after publication in the Official Journal.
