Title
An ordinance to approve and authorize the execution of Amendment No. 10 to the Professional Services Agreement with Camp Dresser & McKee, Inc. for necessary Consulting Engineering Services associated with Parish Project No. S950301, Eastbank and Westbank Regional Wastewater Treatment Plants and associated Pumping Stations and Force Mains, to provide Engineering Services associated with the EPA Grant received by St. Charles Parish.
Body
WHEREAS,      Ordinance No. 95-11-2, adopted November 6, 1995, authorized the execution of a Professional Services Agreement with Camp, Dresser, and McKee, Inc. (CDM) to perform necessary preconstruction, design, bidding, and construction management for the new Destrehan and Hahnville Wastewater Treatment Plants (WWTPs), and,
WHEREAS,      Ordinance No. 96-8-4, adopted August 5, 1996, added the Montz, Norco, Ama, Paradis, Killona, and Bayou Gauche Lift Stations and associated force mains to the original project scope and increased the total project engineering fees to $3,168,842.00, and,
WHEREAS,      Ordinance No. 97-3-2, adopted March 10, 1997, increased the time for resident inspection and construction management, increased the fees for surveying services and fees for the preparation of servitude/permit drawings, and increased the design fee to correspond to construction estimates, thus increasing the total project engineering fees to $4,613,223.00, and,
WHEREAS,      Ordinance No. 98-3-14, adopted March 24, 1998, clarified the design and resident inspection fees for the individual project components, and,
WHEREAS,      Ordinance No. 00-10-8, adopted October 9, 2000, added of out-of-scope work to the original contract at the request of the Parish, the contingency fee was increased by $247,500.00, and,
WHEREAS,      Ordinance No. 01-1-15, adopted January 9, 2001, extended the services date for resident engineering to 31 March 2001, and,
WHEREAS,      Ordinance No. 01-1-16, adopted January 22, 2001, authorized continuance of resident engineering services through the completion of construction and thus increased the resident engineering upper limit to not exceed $1,108,186.00.
WHEREAS,      Ordinance No.  01-12-7   , adopted December 3, 2001, amended the Project Budget is amended as follows:

      TOTAL PROJECT BUDGET      $4,984,956.00
WHEREAS,      Ordinance No. 01-12-16 adopted December 17, 2001 to provide engineering services associated with the EPA Grant to address noncompliant operation of the Luling Oxidation Pond.
WHEREAS,      Ordinance No. 02-3-3 adopted March 13, 2002 the following tasks were authorized to implement the scope of the work plan.
1.      Update at Facility Plans and EID      
2.      Manage Modifications to Luling Pond      
3.      Flow Monitoring and Sewer System Evaluation       
4.      Hydraulic Modeling and Pump Station Improvements       
5.      Rerating of Hahnville WWTP and Grant Administration      
      
WHEREAS,      On July 2, 2002 St. Charles Parish received Administrative Order Docket No. CWA-06-2002-0010 requiring corrective action due to the numerous discharge violations from the Luling Oxidation Pond.
WHEREAS,      On November 19, 2002 St. Charles Parish received Administrative Order Docket No. CWA-06-2003-1758 requiring transfer of Luling Oxidation Pond flows to the Hahnville WWTP to be complete and under operation by January 31, 2006.
WHEREAS,      Activities completed under Ordinance No. 03-3-3 has resulted in a corrective action plan to eliminate discharges from the Luling Oxidation Pond to include the following:
·      Divert flows from the Luling Oxidation Pond through short term improvements to the Bootlegger, Bank, Bourg, and Booster Pump Station and Force Main Improvements.
·      Convert Luling Oxidation Pond to a flow equalization basin and pump station.
·      Provide headworks improvements, hydraulic improvements, ultraviolet disinfection, and aeration improvements at the Hahnville WWTP to treat flows from the Luling Oxidation Pond.
 
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
      SECTION I.      That the Professional Service Agreement between CDM and the Parish of St. Charles is hereby amended and approved to add the following design services to implement the corrective action plan.
      
      CMOM Compliance Activities      $100,000
 
      Luling Pond Design Improvements to Eliminate Discharge
 
·      Design Engineering      $580,250
·      Engineering Services During Construction      $160,000
·      Resident Engineer / Construction Manager      $665,600
·      Supplemental Services / Contingency      $275,000
 
 
SECTION II.      That CDM shall be authorized to pursue and implement additional Federal and State funding accounts to include, but not be limited to the Lake Pontchartrain Restoration Act, Capital Outlay, USCOE Environmental Infrastructure Section 219 and State and Tribal Assistance Grants (STAG).
SECTION III.      That all other provisions of the Agreement, dated December 1, 1995 and as amended shall remain in full force and effect except as stated herein.
SECTION IV.      The funds for the task described under Section I will be provided by the Department of Wastewater Budget.  Individual tasks will be authorized as funds are made available. Partial funding should be provided by STAG funding anticipated by mid - January 2003. The Administration may make modifications to the preceding tasks and funding as needed, but not to exceed the total funding allocated.
