Title
An ordinance amending the St. Charles Parish Code of Ordinances, Appendix A, to modify the definition of truck terminals with video poker gaming facilities; and to modify the requirements for approval of a Special Permit Use for truck terminals with video poker facilities.
Body
WHEREAS,      the Zoning Ordinance stipulates that a Special Permit Use is required for truck terminals with video poker facilities; and,
WHEREAS,      truck terminals with video poker facilities in C-3 Highway Commercial zoning districts is an intensive land use for many commercial corridors in St. Charles Parish; and,
WHEREAS,      regulating this intensive land use to light manufacturing and industry districts (M-1) heavy manufacturing and industry districts (M-2) will reduce the potential for traffic congestion along these commercial corridors and is more conducive with the Comprehensive Land Use Plan; and,
WHEREAS,      regulating this intensive land use to light manufacturing and industry districts (M-1) and heavy manufacturing and industry (M-2) will increase the health, safety, and welfare of the citizens of St. Charles Parish; and,
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I.  That the St. Charles Parish Code of Ordinances, Appendix A, Section III is hereby amended to read as follows:
78.85. Truck terminal (with video poker gaming facilities): A facility covering at least ten (10) developed contiguous acres which sells fuel, lubricating oil, and other vehicular merchandise, such as batteries, tires, or vehicle parts for eighteen-wheel tractor-trailers, and which also meets the criteria of the State of Louisiana for the placement of video poker gaming facilities within said development. (Ord. No. 98-4-17, § I, 4-20-98)
SECTION II.  That the St. Charles Parish Code of Ordinances, Appendix A, Section VI.C.[IV.]1.c.(4), is hereby repealed.
SECTION III.  That the St. Charles Parish Code of Ordinances, Appendix A, Section VI.C.[IV.]1.c.(6) is hereby repealed.
SECTION IV.  That Section VI.D.[I.]1.c.(4) is amended as follows:
(4)      Truck terminals (with video poker gaming facilities) upon review and approval of the Planning Commission, and supporting resolution of the Council (Ord. No. 98-4-17, § IV, 4-20-98). Truck terminals with video poker gaming facilities shall conform to the regulations set forth by the state of Louisiana and to the following regulations:
(1)      Frontage shall be on a median-divided, major arterial with a minimum of 4-roadway lanes, and having federal or state designation.
(2)      Minimum lot size of site shall be ten (10) acres.
(3)      Truck terminals with video poker gaming facilities shall also have all of the following amenities:
a)      a separate truckers' lounge
b)      a full-service laundry facility located in a convenient area for truckers' use
c)      private showers for men and women and not located in an area open to general public restroom facilities
d)      a travel store with items commonly referred to as truckers' supplies (items commonly used only by commercial motor vehicles).
e)      truck scales
f)      separate truckers' telephones
g)      permanent storage facilities for fuel
(4)      These regulations shall not be applied to any truck stops with video poker gaming facilities which have received a Certificate of Zoning Compliance previous to the date of this ordinance, notwithstanding any other provisions of this ordinance.
SECTION V.  That Section VI.D.[II.] 1.b.(4) is amended as follows:
(4)      Truck terminals (with video poker gaming facilities) upon review and approval of the Planning Commission, and supporting resolution of the Council (Ord. No. 98-4-17, § IV, 4-20-98). Truck terminals with video poker gaming facilities shall conform to the regulations set forth by the state of Louisiana and to the following regulations:

(4)      Notwithstanding any other provisions of law, these regulations shall have no force or effect on any truck terminal with video poker gaming facilities which have received a Special Permit Use prior to the effective date of this ordinance,.
