Title
An ordinance to amend the Code of Ordinances by revising Chapter 21, Article I, removing Section (e), and amending Section (f) regarding the installation of culverts on streets containing open swale drainage.
Body
WHEREAS, an Ordinance was passed to amend the St. Charles Parish Culvert Ordinance to establish procedures for the installation of culverts on streets that have open swale/ditch drainage systems and are not pre-engineered for subsurface culverts; and,
WHEREAS, after the amendment to the St. Charles Parish Culvert Ordinance, Section 21-1 (e) still contained language that prohibits installation of subsurface drainage in some subdivisions; and,
WHEREAS, no provisions were included in the amendment to the St. Charles Parish Culvert Ordinance for the Director of Public Works to grant an extension to the Subsurface Drainage Permit if the applicant is unable to complete work during the ninety-day period due to weather or the need to relocate utilities; and,
WHEREAS, no provisions were included to enforce reinstallation and correction of improperly installed culverts; and,
WHEREAS, in order to implement the procedures established by the amendment to the Culvert Ordinance, it is necessary to make modifications to the Culvert Ordinance.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Code of Ordinances, Chapter 21, Article I is amended as follows:
Section 21-1 (e), including subsections, which prohibits issuance of culvert permits, other than for driveway and walkway crossings, in any subdivision designed and constructed based on an engineering design with an open swale/ditch drainage system that was accepted by St. Charles Parish after January 1, 1992, nor in Davis Plantation Park Subdivision Phase I and II, Lagatutta Estates Subdivision, Willowdale Subdivision, and Willowridge Subdivision, Phase I, unless numerous criteria are met, shall be removed from the Code of Ordinances, Chapter 21, Article I.
Section 21-1 (f) shall be amended to include
(8) If the property owner is unable to complete work during the ninety-day period due to weather or the need to relocate utilities, The Director of Public Works may grant a one-time forty-five (45) day extension of the permit.
(9) If a culvert is improperly installed, the department of public works shall notify the property owner in writing following the inspection. The property owner must either reinstall the culvert correctly or remove the culvert and restore the drainage to the previous condition within forty-five (45) days of notification. The property owner must notify the department of public works when corrective work is completed. If a property owner fails to reinstall or remove improperly installed culverts forty-five (45) days after notification, personnel from the department of public works are authorized to remove improperly installed culverts and restore the drainage to the previous condition.
The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
And the ordinance was declared adopted this day of , 2015, to become effective five (5) days after publication in the Official Journal.
