Title
An ordinance to approve and authorize the execution of a License with the Department of the Army, U. S. Corps of Engineers, for the Bonnet Carre' Spillway - Montz Park, No. DACW 29-3-08-217.
Body
WHEREAS, the Parish has established a Public Park in Montz along LA Highway 628 near the intersection of the Mississippi River Levee and the West Guide Levee of the Bonnet Carre' Spillway; and,
WHEREAS, the majority of the Park is located on property acquired by the Parish from the U. S. Department of Interior, recorded in Conveyance Book 130, page 353; and,
WHEREAS, the U. S. Corps of Engineers determined that a portion of the Park is actually located on property which they own; and,
WHEREAS, the U. S. Corps of Engineers agreed to allow the Parish to use the property for recreational purposes in accordance with Ordinance No. 98-12-7, which Lease Agreement expires on November 30, 2008; and,
WHEREAS, the U. S. Corps of Engineers has prepared Department of the Army License No. DACW 29-3-08-217 to replace said Lease.
THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Department of the Army License No. DACW 29-3-08-217 by and between The Secretary of the Army and the St. Charles Parish Department of Parks and Recreation is hereby approved.
SECTION II. That the Parish President, on behalf of the St. Charles Parish Department of Parks and Recreation, is hereby authorized to execute License No. DACW 29-3-08-217.
