Title

An ordinance approving and authorizing the execution of Change Order No. 1 (Final) for the Paradis Canal Flood Control Structure Project No. P080905-10A, grant reference Project Numbers U.S. Department of the Treasury Project No. 1 RDCGR380093-01-00, CPRA Project No. BA-0209, and DRA Project No. LA-51112, as part of the West Bank Hurricane Protection Levee Project, to decrease the contract amount by $60,369.66 and increase the contract time by two hundred and thirty-six (236) days.

Body

WHEREAS,                     Ordinance No. 20-5-2 adopted May 4, 2020, by the St. Charles Parish Council approved and authorized the execution of a contract with Sealevel Construction, Inc. for the Paradis Canal Flood Control Structure Project No. P080905-10A, grant reference Project Numbers U.S. Department of the Treasury Project No. 1 RDCGR380093-01-00, CPRA Project No. BA-0209, and DRA Project No. LA-51112, in the amount of $5,036,169.00; and,

WHEREAS,                     St. Charles Parish executed a Notice of Award with the U.S. Department of the Treasury, Office of the Fiscal Assistant Secretary, Office of Gulf Coast Restoration on July 24, 2019 for $398,727.11 in funding for said project through the Resources and Ecosystems Sustainability, Tourist Opportunities, and Revived Economies of the Gulf Coast States authorized via Resolution No. 6320; and,

WHEREAS,                     St. Charles Parish entered into an Intergovernmental Agreement with the State of Louisiana through the Coastal Protection and Restoration Authority-Board (CPRA) on July 2, 2019 to provide funding not to exceed $2,540,724.00 for said project for the CPRA-Parish Matching Opportunities Program through RESTORE Spill Impact Component funding authorized via Resolution No. 6420; and,

WHEREAS,                     St. Charles Parish entered into an Award Agreement with the Delta Regional Authority (DRA) on November 28, 2018 for funding in the amount of $200,000 for said project through the DRA States’ Economic Development Assistance Program authorized via Resolution No. 6350; and,

WHEREAS,                     Ordinance No. 08-10-7 adopted October 20, 2008 approved and authorized the execution of a Contract for Engineering Services with BURK-KLEINPETER, INC. for necessary professional engineering services associated with Parish Project No. P080905 St. Charles Parish West Bank Hurricane Protection Levee and Urban Flood Control; and,

WHEREAS,                     Change Order No. 1 (Final) is a result of changes within the scope of the contract to modify quantities to accurately reflect the final balancing of the project line items for the construction amount; and,

WHEREAS,                     the decrease in contract amount by $60,369.66 is a result of a decrease in quantity for four (4) bid line items, and increase in quantity for two (2) line items, a deletion of 7 bid line items, and an addition of 4 bid line items; and,

WHEREAS,                     the increase in contract time by two-hundred and thirty-six (236) days is a result of the addition of one hundred and eighty-three (183) rain days, five (5) work change directive days, twenty-three (23) Tropical storm and Hurricane days, and twenty-five (25) days for compliance with State orders for social-distancing due to COVID-19.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     That Change Order No. 1 (Final) for Paradis Canal Flood Control Structure Project No. P080905-10A, grant reference Project Numbers U.S. Department of the Treasury Project No. 1 RDCGR380093-01-00, CPRA Project No. BA-0209, and DRA Project No. LA-51112, as part of the West Bank Hurricane Protection Levee Project, to decrease the contract amount by $60,369.66 and increase the contract time by two hundred and thirty-six (236) days is hereby approved and accepted.

SECTION II.                     That the Parish President is hereby authorized to execute said Change Order on behalf of St. Charles Parish.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
