Title

An ordinance to authorize full and final compromise with Peter and Renee Rizzo, Jody and Patricia Matherne, Jeff and Madelene Melancon, Todd and Andree Roberts, Eve Chaisson and Bobbie Chaisson in connection with the litigation entitled "Peter Rizzo, et al vs. Parish of St. Charles", numbered 57,861, 29^th Judicial District Court for the Parish of St. Charles.

Body

WHEREAS,      St. Charles Parish was sued for allegedly trespassing on petitioners' property and/or that of their ancestors-in-title by installing a sewer force main on properties owned by them; and,

WHEREAS,      St. Charles Parish desires to amicably settle this matter; and,

WHEREAS,      the plaintiffs have agreed to accept the following sums of money in full and final compromise of any and all claims arising out of the allegations in suit numbered 57,861 of the 29^th Judicial District Court for the Parish of St. Charles:  (1)  Peter and Rene Rizzo-$30,000.00; (2)  Jeff and Madelene Melancon-$30,000.00;  (3)  Jody and Patricia Matherne-$30,000.00; (4)  Todd and Andree Roberts-$30,000.00;  (5) Eve Chaisson-$15,000.00; and (6)  Bobbie Chaisson-$15,000.00.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.      That the Parish President is hereby authorized to enter a full and final compromise with Peter and Rene Rizzo in the amount of $30,000.00, Jeff and Madelene Melancon in the amount of $30,000.00, Jody and Patricia Matherne in the amount of $30,000.00, Todd and Rene Roberts in the amount of $30,000.00, Eve Chaisson in the amount of $15,000.00, and Bobbie Chaisson in the amount of $15,000.00.  Said full and final compromise shall release St. Charles Parish from any and all past and future liability, provide for indemnity in connection with the allegations as set forth in the referenced matter, and certain other terms and conditions as deemed necessary by the Parish President.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
