Title

An ordinance to approve and authorize the Parish President to acquire a utility servitude more particularly described in the Donation of Servitude attached hereto and made a part hereof, from Airline and Apple, L.L.C., said property to be used for purpose of constructing, operating, maintaining, repairing and/or replacing public utilities.

Body

WHEREAS,                     the St. Charles Parish Department of Waterworks has a watermain located at the intersection of Airline Highway and Apple Street in Norco, Louisiana; and,

WHEREAS,                     Airline and Apple, L.L.C. is willing to donate a servitude to St. Charles Parish in the area of the existing watermain; and,

WHEREAS,                     the acquisition of the hereinafter described servitude is in furtherance of the public’s best interest and purpose, and is in satisfaction of a public need.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     That the Parish President is hereby authorized to accept donation of a servitude more particularly described in the Donation of Servitude attached hereto and made a part hereof, from Airline and Apple, L.L.C., said property is to be used by for purpose of constructing, operating, maintaining, repairing and/or replacing public utilities.

SECTION II.                     That the Parish President is hereby authorized to execute any and all documents necessary to complete said agreement.

The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:

And the ordinance was declared adopted the ______ day of ___________, 2016, to become effective five (5) days after publication in the Official Journal.
