Title

An ordinance to amend Ordinance No. 91-2-12 an Agreement with the Pontchartrain Levee District for the Lake Pontchartrain and Vicinity Hurricane Protection Project for St. Charles Parish, to provide for a final lump sum payment.

Body

WHEREAS,      the Pontchartrain Levee District is the local non-federal sponsor for the St. Charles Parish portion of the Lake Pontchartrain and Vicinity Hurricane Protection Project; and,

WHEREAS,      the United States Congress has allocated funding to the United States Army Corps of Engineers to provide 100% federal funding for the completion of the St. Charles Parish portion of the Lake Pontchartrain and Vicinity Hurricane Protection Project; and,

WHEREAS,      the Pontchartrain Levee District has executed an Amended Project Agreement with the U.S. Army Corps of Engineers which calls for federal funding in the amount of $39,000,000.00; and,

WHEREAS,      it is the desire of the Pontchartrain Levee District and St. Charles Parish to amend its Agreement to bring St. Charles Parish current based on the 2005 year end estimated project cost of $58,000,000.00 and evidence all payments made by St. Charles Parish through 2000.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.      That Ordinance No. 91-2-12, adopted on February 18, 1991, as previously amended by Ordinance No. 97-2-7 on February 17, 1997, is hereby amended by adding the following paragraph:

8.      Prior to October 1, 2006, St. Charles Parish's Twenty Percent (20%) commitment as set out herein, shall be paid in full in the amount of $548,558.35.  Said payment shall constitute full and final payment for all amounts due the Pontchartrain Levee District under this Agreement.
