Title
A resolution to amend the Parish Council Rules by adding Rule 40: Resolution of Censure of the Parish President, so as to provide a means of censure.
Body
WHEREAS, the Parish Council, being the Governing Authority of the Parish, deems its essential to the proper operation of the Parish Government that the Parish President be, and give the appearance of being, independent, impartial, and responsible to the people; that the decisions and policies of the Parish President be made in the proper channels of the governmental structure and in accordance with all Federal, State, and local laws; and that the Parish President support, follow, and enforce without prejudice all of the laws of the Parish; and that public office not be used for personal gain; and,
WHEREAS, a procedure for censure of the Parish President by the Parish Council, when evidence shows that the integrity of the office of the Parish President has been diminished by an action or inaction of the Parish President, will help provide the public with confidence in restoring the integrity of the office of the Parish President; and,
WHEREAS, the Parish Council wishes to put in place a procedure to censure the Parish President for an action or inaction unbecoming of the office of Parish President.
THE ST. CHARLES PARISH COUNCIL HEREBY RESOLVES TO AMEND THE COUNCIL RULES BY ADDING RULE 40. AS FOLLOWS:
Rule 40: Censure of the Parish President. Any councilmember may submit for Council consideration a proposed Resolution of Censure to publically censure the Parish President for any unlawful action or unlawful lack of action by the Parish President or for any unlawful action or unlawful lack of action of anyone serving under the Parish President’s Administration with respect to one’s oath of office and/or their public service duties and obligations. The proposed Resolution of Censure shall specifically identify and detail the basis upon which the consideration of censure is being brought forth to the Council for consideration. Approval of a Resolution of Censure shall require 2/3rds vote of the Parish Council.
NOW, THEREFORE, BE IT RESOLVED, THAT WE THE MEMBERS OF THE ST. CHARLES PARISH COUNCIL, do hereby approve this resolution to amend the Parish Council Rules by adding Rule 40: Censure of the Parish President, to provide for Censure of the Parish President by the Parish Council.
