Title

An ordinance to amend the St. Charles Parish Zoning Ordinance of 1981, Appendix A, as amended, Section VI. in order to permit transmission towers in the R-1A, R-1A(M), R-1B, R-1M, and R-2 zoning districts as a Special Permit Use.

Body

WHEREAS,                     the Zoning Ordinance of 1981, as amended, defines Transmission tower as: A structure or framework, usually of a steel lattice construction, principally intended to support radio, cellular, telecommunications, television, electric utility and/or any other electromagnetic transmissions, and receiving antennas and/or equipment (Ord. No. 97-7-4, § I, 7-7-97); and,

WHEREAS,                     the Zoning Ordinance of 1981, as amended, also defines Accessory building or structure as:  A subordinate structure, not sharing a common wall with the main structure, the use of which is incidental to that of the main structure; and,

WHEREAS,                     the St. Charles Parish Council wishes to provide for transmission towers to be permitted, for personal use, as residential accessory structures in residential land use zones in a way that promotes the public health, safety, and welfare.

THE ST. CHARLES PARISH COUNCIL HEREBY ORDAINS:

SECTION I.                     That the Code of Ordinances, Appendix A, Section VI., B., [I].1.c. Special permit uses and structures [in the R-1A zoning district] is hereby amended as follows with new text in underline and deleted text in strikethrough:

(10) Transmission towers when accessory to a permitted use.

SECTION II.                     That the Code of Ordinances, Appendix A, Section VI., B., [II].1.c. Special permit uses and structures [in the R-1A(M) zoning district] is hereby amended as follows with new text in underline and deleted text in strikethrough:

(8) Transmission towers when accessory to a permitted use.

                     SECTION III.                     That the Code of Ordinances, Appendix A, Section VI., B., [III].c. Special permit uses and structures [in the R-1B zoning district] is amended as follows with new text in underline and deleted text in strikethrough:

(11) Transmission towers when accessory to a permitted use.

SECTION IV.                     That the Code of Ordinances, Appendix A, Section VI., B., [IV].2. Special permit uses [in the R-1M zoning district] is amended as follows with new text in underline and deleted text in strikethrough:

(c) Transmission towers when accessory to a permitted use.

SECTION V.                     That the Code of Ordinances, Appendix A, Section VI., B., [VII].1.c. Special permit uses and structures [in the R-2 zoning district] is amended as follows with new text in underline and deleted text in strikethrough:

(7) Transmission towers when accessory to a permitted use.

                     The foregoing ordinance having been submitted to a vote, the vote thereon was as follows:
